Could Trump Plug the Anchor Baby Loophole?

If Donald Trump is elected in November (not a foregone conclusion) would he attempt to plug the anchor baby loophole?

That’s the insane policy by which babies born to illegal alien mothers on U.S. soil receive automatic birthright citizenship.

Thus, American nationality policy is taken from U.S. lawmakers and turned over to foreign lawbreakers.

Would require a change to immigration law. Let's say for the sake or argument that the Republicans take the Senate and keep the House - what do you think the odds are that Mike Johnson and Mitch McConnell would support such a change?

It’s national suicide. I don’t know of any other country that allows birthright citizenship for foreign invaders.

I understand the pros and cons but it’s still wrong on so many levels.

This problem should have been addressed a long time ago.

I think it would be worth a shot in court arguing the “subject to the jurisdiction thereof” clause of the 14A could be reasonably argued that a born child of non-citizens cannot be interpreted as being a person subject to the jurisdiction of the US government.

Canada has the same policy and they are getting overrun also. No other First World country has such a policy. Some Third World countries have similar policies but it doesn’t matter because most people don’t want to move there.

CONGRESS has the exclusive, enumerated power over immigration. All any President can do is either sign or not sign the legislation.

I dont think its law.

It was a supreme court decision in like 1982 that re-interpreted the 14th amendment to allow anchor babies.

My though is he just uses executive authority to stop it....thus forcing it to go back through the court system to the scotus.

The president can do lot by making executive orders and stuff like that. What would probably happen is that it gets sent to the Supreme Court.
