Will Donald Trump avoid prison? It may depend partly on his ability to convince a probation officer that he would be “amenable to supervision.”
That’s according to Martin Horn, a former commissioner of both the New York City Department of Probation and the city’s Department of Correction, who spoke to POLITICO Magazine about the process Trump is about to undergo as he tries to stay out of the slammer.
In a typical case, a convict will be interviewed by a probation officer in the days after the verdict and be given the opportunity to accept responsibility and present mitigating factors that could reduce any sentence. That is going to be difficult for a man who has constantly railed against the case against him — not to mention the very judge who will decide the sentence.
Horn, who is a professor emeritus at John Jay College of Criminal Justice, said a probation officer will have to answer: “Is this individual going to accept that he has been justly convicted and accept the strictures and restrictions and requirements of a probation sentence?”
That will be one of several key factors for Justice Juan Merchan to weigh before he announces his sentence for the former president-turned-convicted felon on July 11.
Here’s how it all might play out for Trump.

Now that’s thinking out side the box. You may be right, altho it would be an excuse for Biden to dodge the second debate.
Keep in mind the there might be post trial motions that could postpone sentencing - like the post on the court’s website about the jurors’ cousin.
Yes it is absurd.
In your opinion, do most probation officers lean right or left?
Are officers chosen at random or can they be specially appointed?
The Marxists keep trying to make their obnoxious New York totalitarian reign over Trump as disgusting as humanly possible.
Sorry, but the question is too general. I never practiced in NY, so I don’t know. However, as 80% of people in that jurisdiction are dems, I have to assume that the DPO is one also.
The fact remains that no felonies of this class go to prison in NYC. Trump would be the exception, which should come as no surprise. Keep in mind that he should have a right to bail pending appeal.
Yeah, they want the electric chair for him, and once that’s done, a firing squad for the rest of us.
And, sorry, but I have no idea how they are appointed in NYC.

Doing virtual rallies could really work. He could have several at one time with the humongous screens in stadiums. They’d have to have the timing down, and line up speakers to warm up the crowd in each location. It might even save the campaign money.
This would solve security issues and simplify the campaign travel logistics. It would also allow Trump to hold rallies in more hostile locations.
He’d probably need to work with Elon Musk and Star Link to keep the left from interrupting the feed
Put him in jail and he will raise a $Billion in a month.
I will do my very best to honestly earn the mutual respect and vote of every member of the Department of Corrections I encounter.
It continues to be my firm and honestly held belief that moneys paid to a lawyer for his time & skill and as consideration for a non-disclosure agreement could be considered by a reasonable lay person as legal expenses.
This article from Politico is inaccurate he simply needs to tell the probation officer yes I understand what happened but I am innocent and that will be proven in appeal and if you want me to meet the terms I will gladly have someone appointed by the state of New York to come on the campaign trail with me.
That will accelerate the appeal process to the federal level and he doesn’t want that considering Trump has raised close a half billion dollars and polling showing Biden got a small pump in some polls and none in others.
They simply want Trump to have the felon tag on him for November 5.
I am a person very familiar with the term “legal expenses” gained through many years of expensive experience.
I might very well hold the record for a human being with respect to “legal expenses”.
“accelerate the appeal process to the federal level”
This case is so egregious that the federal courts will initially defer to NY courts of appeal.
Seems like a good time for a nationwide strike
Trump reports to jail.
Trump climbs another 8 points in the polls.
I’m hoping that judge will be talking to a probation officer after Trump’s in office.
Probation officer: “so Mr. Trump what are you doing about seeking employment?”
Trump: “I am running for President of the United States”.
Probation Officer: “OK. Let me make a note of that. OK. Next question ...”
