LIVE: Chauvin Trial Day 9 – State’s Evidence Begins to Align with the Defense Narrative of Innocence

...[E]ventually the state ran out of sobbing and crying bystander witnesses, and the prosecution’s narrative was obliged to begin talking about facts. And the apparent trend to my eye is that the more the state talks about facts, the more their narrative of guilt begins to closely resemble the defense narrative of innocence.

From the state’s telling, fentanyl had nothing substantive to do with Floyd’s death. Sure, Floyd was an addict, but that wasn’t a factor to which we should attribute his death, but merely another reason to sympathize with the struggling Floyd, who was after all still a loved human being despite his addictions. Don’t pay any attention to the drug narrative, that’s not what killed Floyd!

Rather, what killed Floyd was Derek Chauvin’s “blood choke” knee to Floyd’s neck. Or maybe it was a respiratory choke delivered by Chauvin’s knee to Floyd’s neck. Or maybe it was mechanical asphyxiation resulting from the pressure applied by all three officers holding Floyd prone. Or maybe it was positional asphyxia because they failed to put Floyd in the recovery position. Or maybe it was that the officers should have started chest compressions on the handcuffed, huge, and just-violent Floyd before EMS showed up. Or maybe, or maybe, or maybe … Does it really matter. Chauvin’s knee!!! Excessive force!!! Not a trained technique!!!

Unfortunately for the state, many of its own witnesses, especially its use-of-force and medical witnesses, whether existing MPD trainers or well-paid expert witnesses from out of town, have testified in ways that substantively undercut that narrative of the state...

He should receive financial compensation for the hell he has been put through-equivalent to every dime he would made over his lifetime as a police officer up until the time of what would have been his retirement, his full retirement benefits including medical and dental insurance, and a large cash lump sum to compensate for the mental anguish he has been put through and to pay for any and all personal safety and security needs that will certainly arise from his acquittal.

Chauvin is innocent and that will be proven in court. He was the victim here, not the George Floyd. George Floyd killed himself when he ingested a lethal dose of fentanyl to hide it from the police. That's why he was freaking out. He knew he was getting ready to OD.

This is all guerrilla theater to them.

They were going to use Aubery but this had much better video.

There is an innocent White person murdered every 15 hours in the US by a black but you never hear about it.

This is all part of the plan. You don’t need a crystal ball. He’s acquitted. There are massive riots. The government (deep state) has to step in to suspend any of those antiquated constitutional rights.

Lack of oxygen killed Floyd. Not 3x the lethal dose of fentanyl.

Yeah, I heard that testimony. Absolute rubbish, a renowned expert for hire. If George's lungs were
filled with drug induced fluid, as the autopsy showed, and George then experienced dry-land drowning
then, yes, his body was starved of oxygen.

I don’t believe that today’s witnesses were all that impressive or devastating.

I do agree that Nelson did not take them apart on cross examination they way he has done with previous witnesses. So today’s witnesses seemed like better witnesses than the the last couple day’s witnesses, who were truly pathetic.

I think Nelson knows the best way to attack these witnesses is with his own experts.

In my opinion, there will be no way at the end of the trial that any critically observant person can say that the State has proven Chauvin’s conduct led to Floyd’s death beyond a reasonable doubt. I will be very disappointed with the judge if he doesn’t take that issue from the jury on that basis.

Scott Adams today said, and I don’t know how much was tongue-in-cheek versus an actual likely scenario from how things sound, that the defense is going to call some of the prosecution’s expert witnesses as defense witnesses. That is how bad things are going for the prosecution, according to him.
He also speculated that Chauvin might have a case for malicious prosecution.

That’s all well and good but this jury is not aquitting. We have learned one big thing in last year is that mob violence supported by Government works.

Unfortunately, the jury is composed of Minneapolis leftists. A suburban or rural jury would acquit in a heartbeat. The 3 black jurors will vote on emotion, as will the white leftist women. There are probably 3 or 4 jurors who will give Chauvin a fair shake, and they know they are under pressure to convict.

Today’s witnesses were so technical, I’m sure the juror’s eyes were glazed over by the end. Probably didn’t understand any of it.

Yesterday however, defense won with the prosecutor’s own hand picked witness and even paid expert. That was a thing of beauty and even normal people with no medical degree could understand it.

Yesterday kind of sealed it. Highly technical medical types having different opinions isn’t going to sway a jury and I assume the defense will have their own highly technical medical types.

Bla bla bla is all the jury will hear on that stuff.

Chauvin did not use excessive force as of yesterday’s easily understandable testifying.

Branca has since updated his blog post with a fuller recap of the day’s events. One thing I didn’t realize from reporting earlier in the day is that the ‘animations’ and huge volumes of other material prepared by one of the experts, wasn’t made available to the defense until just the NIGHT BEFORE he testified.

I guess timely discovery is considered optional in MN courts when a ‘racist cop’ is on trial for murder.
