Will the Senate Really Take Up Donald Trump's Impeachment?

The timeline of President Donald Trump’s second impeachment trial remains uncertain as the Senate came back from recess Tuesday to confirm a spate of President-elect Joe Biden’s Cabinet nominees.

House Speaker Nancy Pelosi (D-Calif.) provided no clear indication over when Democrats would formally transmit the article of impeachment to the Senate that charged Trump with “incitement of insurrection” for his lead in the riots on the U.S. Capitol building.

“In terms of the timing, as I mentioned, one week ago, on January 6th, there was an active insurrection perpetrated on the Capitol of the United States incentivized by the President of the United States,” Pelosi told reporters Friday. “One week later, Wednesday to Wednesday, that President was impeached in a bipartisan way by the House of Representatives. So urgent was the matter they’re now working on taking this to trial, and you’ll be the first to know when we announce that we’re going over there.”

Trump will be a private citizen in under 2 hours. The sole remedy of impeachment is removal from office. The procedure is moot at this point.

How can you impeach a private citizen?

If this is the case...then just Democrats can just impeach the GOP nominee before he even takes office...then they won’t even need to steal the election. The GOP won’t have anyone available to run for office.

They have announced that they plan to impeach him in retrospect so that they can have a trial in the Senate, get him convicted, and prevent him for ever holding or running for office again.

In other words, they’re still afraid of him, and they want to drive a stake through his heart.

Is it Constitutional? Probably not. Will that stop them? No.

Of course they will.It's just a matter of how many "Republicans" will vote "guilty". At least 4 or 5....and very,*very* possibly more. Now that McConnell has declared him guilty it's easy to imagine a "guilty" verdict.

At that point the President must challenge any prohibition that he be barred from office.

Why wouldn’t they? It’s their only chance to rid the world of Trump 2.0, I can’t imagine them not doing it, and convicting him.

Impeachment and conviction may also bring prohibition against holding future office or position in government. I have seen arguments that pensions and secret service protections could be revoked as part of the penalty phase trial after conviction. The Democrats and likely a minimum of 17 Republican Senators would enjoy the utter destruction of Trump over and beyond his not being in office.

There is more than one “remedy” for Impeachment. There are actually three:

- removal from office
- deny of some to all benefits (pension, protective services, etc)
- bar from any future office

Dems are pushing for the bar from future office

A trial sounds like a perfect reason for the Senate to cease all other work. No confirmations of appointees, no legislation. I’d say it should take 18 months to properly try such a serious charge. I mean “insurrection “ strikes at the heart of our country. Everyone arrested should be brought in and questioned. Plus any first hand witnesses. The House did no investigation so it falls to the Senate to properly vet the charges.

I do not know the law (if it even exists). Can the House hold on to this impeachment for when (if) Trump wins in 2024?
