NEW: The office of the National Archives tells @NBCNews it received alternate slates of electors from the GOP in 5 states: AZ GA NM NV PA
BUT, those slates were not forwarded to Congress b/c the Electoral Count Act allows them to only pass along slates certified by the states. 170 926 2.3K
Frank Thorp V @frankthorp · 4h Alternate slates of electors received from entities that are not the state government (the governor or the state legislature) are considered private correspondence, so were not made public until obtained by @PeteWilliamsNBC and @NBCNews via a FOIA request.
Nice legalistic sophistry. Maybe that will be a comfort for you when the war starts. This really is the hill to die on. There is no 2022 and 2024.
Damn this sucks. But the choice is that it goes to arms, or we live under an American USSR, or as our own Matt Bracken called it, “Amerizuela”.
We’ve been saying that this is how it works since Nov. Some here chose not to listen.
Biden’s the president, get use to it. Write letters, have long memories, donate to other candidate’s, makes do difference. We were too nice over the years and the saying “nice guys finish last” is true.
Agree...
And yet, more than a few people here said that Pence didn't have that power.
Are these same people now going to criticize the National Archive?
You bet.
If the electors were certified illegally, Pence can reject them (will he?). If he does, then neither gets 270 and it goes to 1 vote per state. The pundits say Trump will win cause most are repubs. However, what we seen lately, will those rhinos have the sinews to do what’s right? Loosing sucks!
As it says right in the post, the Electoral Count Act allows the National Archives to only pass along the slate of electors certified by the state. That is literally the power given to it by law. If you or I sent in a slate of electors, they would not pass that along.
Establishment RINOS were too nice because they didn't care about the people they represented. We on the other hand, allowed them to get away with it, settling for status quo. I live in New York State, and have been stuck with Democrats for the majority of my adult life. I can't imagine what it must be like to live in a Red State, and have your so-called Republican Congress-critter stab you in the back. At least I know where I stand with a Democrat Congressman/Senator. I'm nothing to them, and will always be nothing to them. I know they'll always screw me whenever they can. The only regret I have is that NY State will never be able to get rid of them. As of now, if no one wants to handle voter fraud, then I'm done voting. I will not waste one more of my precious votes on a party that doesn't believe my vote is worth fighting for.
Actually you've been saying that Pence didn't have the power to reject slates of electors.
Now, you're saying that the National Archive does have the power to reject slates of electors.
Been saying this for some time. The legislators can talk all they want, but without action, the certified slate wins.
Hate to say I told you so, but I told you so. (Not you specifically but other people that were talking about “alternate” electors).
This is why PDJT was asking states to decertify. He needs that to happen.
The Constitution says that it's the legislatures that send the electors for the states and not the state governors.
The law you mention abridges the the constitutional rights of the state legislatures.
All these naysayers are all so tough behind a keyboard!
They do t make the decision on what is an illegal damage of electors. By law they can only forward the electors that were certified by the states.
The pundits say Trump will win cause most are repubs. However, what we seen lately, will those rhinos have the sinews to do what’s right? Loosing sucks!

Losing one’s country is beyond just sucking ...
Where do we start? More to the point: WHO do we start with?
The twelfth amendment to the U.S. constitution said “... and transmit sealed to the seat of the government of the United States, directed to the President of the Senate;–the President of the Senate shall, in the presence of the Senate and House of Representatives, open all the certificates and the votes shall then be counted ...” The twelfth amendment made no mention of the votes being sent to the National archives.
