Did Chief Justice John Roberts Accidentally Guarantee the Re-Election of Donald Trump?

I'm not a lawyer, just a verrrry interested layman. Obviously I have been following very closely the obvious election fraud on a massive scale that just took place. However, setting aside the data proving the fraud, just the legal issues alone should give Trump the win.

On October 19, Chief Justice John Roberts sided with the liberals on the Supreme Court and voted to allow the decision of the Pennsylvania Supreme Court decision, CONTRARY TO STATE LAW, to allow the counting of mailed ballots up to three days after election day. The vote was 4-4 at the time due to a vacancy on the Supreme Court, thus allowing the Pennsylvania Supreme Court decision in VIOLATION OF STATE LAW to remain in place.

Did you notice that I emphasized "VIOLATION OF STATE LAW?" That is because the 2020 election in Pennsylvania was conducted in VIOLATION OF STATE LAW.

As Daniel Horowitz and Mark Levin pointed out, State Legislatures can choose presidential electors. There has been a lot of push back and "fact checking" on this to declare that they are wrong. Well, they are wrong. State Legislators cannot choose a slate of electors contrary to the recorded vote...EXCEPT when the election was conducted in VIOLATION OF STATE LAW.

Thanx to Justice Roberts not taking a stand on the Pennsylvania Supreme Court, that state went ahead and openly counted mailed ballots three days (and beyond) after the Nov. 3 election in VIOLATION OF STATE LAW.

Therefore if the state legislature of Pennsylvania, in response to the overwhelming evidence of vote fraud plus the slap in the face the governor, his administration, and the state courts gave to the legislature by ACTING IN VIOLATION OF STATE law choose the the electors they have the legal right to do so. Of course, the state Democrat Secretary of State will not certify the electors chosen by the state legislature and will only certify the electors chosen due to a fraudulent election conducted in VIOLATION OF STATE LAW.

So which set of electors get to vote in the electoral college? Well, I think you see where this is heading and, yup, it is heading to the U.S. Supreme Court where despite their reluctance to get involved in election matters they have no choice but to do so. However, rather than get involved in analyzing election data which could take a long time, their concern is strictly legal. And it boils down to this, do the state legislatures have the constitutional right to choose the electors if the election was conducted in VIOLATION OF STATE LAW?

The answer for Pennsylvania is obvious.

This is well and good, but we need to be thinking about how to keep the Democrats from stealing the two Senate races in Georgia. Not that we give up on other things, but this is the only chance to build a wall around Biden if he is installed. We have to fight on many fronts.

If the law is not followed, then the legislature as the supervening authority has the right to choose the electors themselves.

Right. And the "fact checks" out there claiming that the state legislatures have no such right leave out the vital matter that they do have such a right IF they find that the elections have been in VIOLATION OF STATE LAW.

Alito also noted in his statement that there wasn’t enough time to hear the case on the merits and rule before Election Day. He also warned about exactly what we’re seeing happen.

The post-election “fight” doesn’t really even start until we see how the PA case at the Supreme Court shakes out. It looks like the SOS there basically just ignored the 8 pm order and it was the fact that she said she was going to mind the 8 pm order that gave Alito comfort to punt the case in the first place. If he finds out that was a lie or scam, there’s no way he’ll accept it, nor will probably even Roberts.

The question is NOT a matter of invalidating the PA results. The question is ruling on whether the state legislature has the right to choose a set of electors due to VIOLATION OF STATE ELECTION LAWS.


As somebody else pointed out, that is what Democrats hoped for in 2016. That didn’t happen then and it won’t now. The GOP is punting to the courts. This fight isn’t over. We need to fight for every inch but the outcome has been set. We must never allow the GOP to legitimize this robbery.

GA voters pissed off about the election steal will be more than motivated now to go out and vote in the Senate runoffs.

I’m having a hard time caring about GA right now. Let China Mitch and Romney go to Fulton county and get their votes.

You may think it’s in violation of state law but the Supreme Court has always said that the State supreme court is the final say on that. They likely won’t even consider that issue.

That is not to say that the Supreme Court would not entertain an appeal if the state Supreme Court were corrupt or the state decision was so devoid of merit that it violates the Due Process Clause or the guaranty of a republican form of government, but I’m not getting the impression that the Trump team is even going to argue that much less prove it.

In their ‘pseudoverse’, there is no probable cause for making such allegations. In the real world, there is an abundance of it, and together with additional actionable intelligence, I don’t see how we don’t have a case. Initiate, strike and follow through. Wash, rinse and repeat. Drain the swamp and the pseudoverse implodes at a safe distance. Proceed with caution and keep the faith.

We have to plan for every scenario. We have to fight on multiple fronts because the enemy is attacking on multiple fronts. Keeping the Supreme Court with 9 Justices and not 15 rubber-stampers like the Democrats plan is crucial.

You are assuming that the PA state legislature is up to the fight and rioting that are bound to occur if the do. Politicians for the most part are cowards.

PA legislature is heavily weighted towards GOP. In the State senate it is 28 GOP to 21 Dem with 1 Indy. In the State House it is 109 GOP to 93 Dem. So even if a few waver there is still more than enough.

I believe you are wrong. ACB has maintained that legislatures determine policies, not judges.

She will not care what excuse a state or lower federal court gives for making exceptions to the law. If a state legislature wanted to change the law because of COVID-19, they could have done so: but they didn’t.

No. it is not legal— they re-wrote the Legislatures election laws, violating PA Constitution. In a Federal election they have again violated the US Constitution...blatantly. These are not separate things for a federal election.

Doing the best triage we can in an emergency isn’t acquiescing to the fraudsters. We have to outflank the enemy and preserve as much of the Republic as we can. A few things come to mind:
1. Keep the Senate and preserve the Supreme Court.
2. In Red states, reform the election system and laws to make it harder for Democrats to cheat in the Blue parts of Red states.

Yes, don’t give up on helping Trump fight for a fair election, but we know the system is corrupt.

We won’t win a purely defensive war but there are some things we must preserve and protect if we are ever to survive and strike back. Striking back means we make new rules, not playing the Democrats’ game like the GOPe always does.
