James Comey had a rather funny defense for all the shenanigans going under his nose while he was FBI Director: he was completely incompetent. As you can see in the clip in the video above and at greater length at the video link below, Comey went full incompetent fool at the Senate Judiciary hearing. It had to be incredibly humiliating but it sure beat the alternative of testifying that he knew what was going on all around him and end up indicted.

Everyone saw this coming. Comey is a slime ball to the nth degree. He’s not saying a thing and setting up a defense that everything he did, someone else did and he didn’t know a thing about it. He will not implicate himself in anything. No one would. And he’s muddying up the water even more. But it’s good to get him on record under oath.

Simply look up Hinds Precedents, especially chapters 53 and 51, and Cannon’s Precedents, especially chapters 184-185. You’ll find numerous detailed cases of Congress asserting its power, arresting people, holding them until they agreed to answer questions, and then releasing them. Some of these people did not refuse to appear, but simply failed to satisfactorily answer questions.
