(Sep. 19, 2020) On Friday night the Twitter account @kamalakancel posted images of what it said were four documents appearing to show the immigration history of Shayamala Gopalan Harris, the mother of Democratic vice-presidential candidate and U.S. Senator Kamala D. Harris.
To date, Kamala Harris has not responded to questions about her parents citizenship status when she was born in Oakland, CA on October 20, 1964 and, more broadly, whether or not she qualifies to serve as a natural born Citizen.
Some interpret the Article II, Section 1, clause 5 requirement for the president and commander-in-chief to signify a person born in the United States without respect to his parents citizenship, while others point to the different standard for the nations chief executive as opposed to that of a Citizen for U.S. senators and representatives set forth in Article I.
While the Constitution is silent on vice-presidential qualifications, the 12th Amendment, ratified June 15, 1804, states in its conclusion:

The 1790 Naturalization Act was totally repealed as being in error and replaced by the 1795 Naturalization Act and the words natural born Citizen were changed to just Citizen, since James Madison pointed out to the Congress that the 1790 Naturalization Act was in error in that wording. Adjectives mean something. Naturalization Law cannot create a natural born Citizen. Only Natural Law can do that via the person being born in the USA to parents who are both U.S. Citizens (born or naturalized), when their child is born in the USA. Such a child is at birth instantly born with unity of citizenship and sole allegiance at birth to one and only one country. That was the founders and framers intent, meaning, and understanding in the selection of that term for the Presidential Eligibility Clause in our U.S. Constitution.

People can argue until they are blue in the face, but this is reality in the 21st century: Anyone who is a citizen by birth, be it to citizen parents or birth on US soil, is eligible to be President. It applied to Obama, Ted Cruz and John McCain, and it applies to Harris. Attacking her with this argument is counterproductive and will just make her a more sympathetic candidate. It will help them build a false narrative of an underprivileged child rising above discrimination and racism. I guess the folks who pushed the Obama birther stuff figure that worked out so well, why not try it again?
All of this ‘Obama’s a Kenyan’ Part Deux business should have been vetted ages ago. If there was a question of her eligibility, it should have been raised during the primaries, not six weeks from the general. Besides, liberals attack each other like rabid wolves when trying to establish their dominance - I’d think one of the others would have smelled this one out and used it against her back in midsummer.

When my grandfathers were born in the US, in 1893 and 1895, their parents were subjects of the Emperor of Germany, Wilhelm II, and of Her Britannic Majesty Victoria Alexandrina.
When my grandfathers registered for the draft in 1917, their draft cards offered three, and only three, types of citizenship status: Natural Born, Naturalized, or Alien.
Since they were never naturalized, and since they exercised all the rights and privileges of citizenship including voting in elections, one must conclude that, in 1917, they were considered to be natural born by virtue of their birth in New York or Connecticut, respectively.
And if they were NOT natural born citizens, and were never naturalized, then they must have been, according to this reasoning which is on this website constantly, aliens, so my father and mother could not be natural born citizens either, and then neither am I, since my parents were never naturalized, and neither was I.
I was taught in high school, in my Constitution class in 1967, that NBC = “born here”. The only reason this has come up now is because of Obama, who had many more cogent reasons to be opposed than this ridiculous theory about two citizen parents.
McCain was a US citizen. His US citizen parents were serving in Panama Canal. Otherwise no pregnant US Mother would leave the USA.

The 14th Amendment has absolutely NOTHING to do with eligibility for President..
That Amendment was to give citizenship to slaves & their children. It was done in the 1800’s...right after Lincoln.
Dems & others are trying might hard to twist the 14th Amendment into a place that makes Kamala eligible.
My brother & I are both pretty political. However, he is convinced that the 14th Amendment saves Kamala’s ass.I am still working on getting him to read the 14th Amendment carefully & apply it to the time period in which it was created.

Even if he was born in Hawaii his father was a citizen of Kenya here on a student visa.
His mother didn’t meet the requirements to pass US citizenship to him.

People have a really hard time understanding Natural Born versus Native born.
When I compare it to having AKC registered pups versus mutts, they sometimes understand.
Kamala avoids any conversation about her status, because SHE KNOWS she is NOT eligible to be either President or Vice President-—or to hold any position that can succeed President.

There’s territorial jurisdiction, which covers EVERYONE: you’re subject to the laws of the country bounded by its borders.
Then there is political jurisdiction, which means what nation are you a subject of: the English nation, subjects of the King; the Chinese nation, formerly subjects of the Emperor; the Spanish nation, subjects of the King of Spain...which I most definitely am NOT.
It means, what Sovereign are you a subject of?
In the United States, the People are Sovereign...we have no King. Or Emperor. But the term “People” is a term of art within the law, that means the citizenry...not including aliens unnaturalized.
This is what the 14th Amendment referred to: “And Subject to the Jurisdiction of...”.
You have to be a citizen, or at least on your way to being a citizen, in the United States, to be considered under the political jurisdiction of that citizenry...or else you are NOT “Subject to the Jurisdiction of..”.
So in the case of Shymala whatever her last name was and Don Harris, they were under a) the jurisdiction of the Prime Minister of India and b) the British Crown, respectively.
The Indian case may be a bit more complicated since they are in fact supposedly a Constitutional Democracy. In that event, the populace may be said to be Sovereign similar to the United States. But Shymala was still subject to the jurisdiction of that people and that state, since that is what her declared nationality was. If she got into any kind of hot water back then, the Indian Consulate would be involved. THAT is the definition of someone who is NOT “Subject to the jurisdiction” of the United States, even though they might be prosecuted for a crime IN the United States: only by treaty are certain Diplomats exempt from such things.
She does with her father—Jamaica.
It is unclear how India handles such issues.
