White House insists Trump has authority to block American companies from doing business in China

White House economic adviser Larry Kudlow asserted President Trump’s threat to block trade between private Americans businesses and China, saying he has “emergency economic power authority” to do so.

“Do you believe that the president does have the authority to block private businesses from investing in China?” CBS News' Margaret Brennan asked Kudlow on “Face the Nation” Sunday.

“Ultimately, he does have authority,” responded Kudlow. “It’s an emergency economic power authority,” he said, adding that Trump “is not intending to” block trade with China at this time.

Amid an escalating trade war, Trump in a series of angry tweets Friday “ordered” American companies “to immediately start looking for an alternative to China, including bringing our companies HOME and making your products in the USA.”

The only authority the President has is that enumerated by the Constitution of the U.S. Unless it is a bona-fide, short-term national emergency, I see nothing in the Constitution that gives Trump power to interfere with buyers and sellers between the U.S. and China. This whole China-Is-The-Reason-For-Our-Economic-Woes thing has gone far enough.

Congress has granted the POTUS this power by Statute.

In place since 1977 to empower Jimmy Carter in dealings with OPEC.

Dumb bastards never repealed it.

He can PROSECUTE any company or individual who does business with any country he puts off limits.

And put them all in prison.

Or, shoot them if they resist arrest.

Trump puts out this statement, knowing it will generate fire and fury in the media, but for another purpose(s) as well.

Describe and discuss the likely reactions to this statement from public company CEOs, private company CEOs, investement banks, and Wall Street analysts.

Then describe likely counter-responses from China as well as other international trading partners, including the potential impact on US-China trade negotiations. Address specifically the impact on tariffs and trade negotiations and the implications of this statement with respect to China’s agricultural crisis (African Swine Fever and armyworm infestation.

Finally, what is the likely outcome - will Trump ever use these powers or will this statement set the stage for other actions, if so, when and what.

I can answer most of that, but I’m too old and tired to write it out. Short answer: Trump is exerting psychological pressure on companies to encourage them to leave China.

Which would be a good thing.

China indeed manages its trade very carefully, of course for its own benefit. I appreciate Trump has pointed this out to Americans and has pushed business, particularly big business and high-tech, to begin to look (especially the USA!) elsewhere for manufacturing.

You will note also that in this particular area, the normally psychotic Left and Democrat party has said nothing against Trump. Chuck Schumer even publicly expresses agreement. It shows me that there is broad agreement on this.

But I agree with you - “outright blocking” is indeed US Government simply doing to Americans exactly what China does to its own citizens.

All that concerns me is someone like Harris saying the gun situation in our country is a national emergency and banning companies from doing business with countries that sell arms, or some such insanity.

Some powers should only be allowed for SANE presidents :)

President Trump has the authority to deny entry to foreign cargo arriving by sea, which is a de facto block of American companies from doing business WITH China involving receipt of goods FROM China.

Here is more US Code that authorizes the President to suspend cargo shipping:

A Google search has revealed an interesting law called The Carriage of Goods by Sea Act, which is a part of Title 46 of the US Code.

The act itself was moved from 46 United States Code §§ 1300-1315 to a note in 46 United States Code §§ 30701, but it is still there.

Here is the interesting and relevant section of the US Code:


“[SUSPENSION OF PROVISIONS BY PRESIDENT] “Sec. 14. Upon the certification of the Secretary of Transportation that the foreign commerce of the United States in its competition with that of foreign nations is prejudiced by the provisions, or any of them, of title I of this Act, or by the laws of any foreign country or countries relating to the carriage of goods by sea, the President of the United States may, from time to time, by proclamation, suspend any or all provisions of said sections for such periods of time or indefinitely as may be designated in the proclamation. The President may at any time rescind such suspension of said sections, and any provisions thereof which may have been suspended shall thereby be reinstated and again apply to contracts thereafter made for the carriage of goods by sea. Any proclamation of suspension or rescission of any such suspension shall take effect on a date named therein, which date shall be not less than ten days from the issue of the proclamation. “Any contract for the carriage of goods by sea, subject to the provisions of this Act, effective during any period when title I hereof, or any part thereof, are suspended, shall be subject to all provisions of law now or hereafter applicable to that part of title I which may have thus been suspended.
I think Trump's use of the word "carriers" was intentional, because the President has the power to suspend contracts by carriers with foreign nations under this act (at least for carriage by sea).

Of course he has that authority. See above. It most likely IS constitutional, especially the way China is acting.
