Full Title: Republican lawmaker, NRA lobbyist challenge Florida sheriff on 'Stand Your Ground' stance in shooting.
... The incident was captured on surveillance video and drew national attention. The argument began when Drejka questioned McGlocktons girlfriend about parking in the handicapped parking space without a permit while McGlockton went inside the store.
He told deputies that he had to shoot to defend himself. Those are the facts and thats the law," Pinellas County Sheriff Bob Gualtieri was quoted as saying. No matter how you slice it or dice it that was a violent push to the ground. ...

Great, but you said that didn't matter.
"are we now going to pretend on FR that blatant thug attacks dont happen all over our country...[a bunch of stuff that has nothing to do with the point]"
You said, "bull. thats not what the law says. The law says its about the victim determining if hes in fear for his life."
That is wrong. His subjective fear is not the legal standard.
Sorry dude, I’ve run into too many road rage incidents in the road rage capital of the world. I’ve been threatened with shotguns, machetes, baseball bats, and even a car before I figured out you simply do not frack with anybody you don’t know. So unless he’s actually physically threatening somebody with me, like my wife, my children, and other family members or close friends. I’m just going to put myself between them and back off while trying to de-escalate the situation. You would be surprised how easy it is when you assume the role of a parent while assigning them the role of a child and kindly ask them their side of the story ... even if you think you know what their story is going to be.
If he didn’t have the gun, I can easily see him getting beat to a pulp, with traumatic brain injury, and never again walking without a cane or a walker. Those of us near big blue cities, we see it in the news every month.
This is why a million guns a month were sold in Obamas final year in office. Vicious crippling beatings. This guy knew it was coming. He was in a life or death situation, and when he’s pointing the gun, he’s focused on the target, his chest. He only sees the target, he doesnt know if the guy is leaving or not, but he knows the guy will beat him to a pulp, as his actions have just proved that. Its a split second decision. As he is pulling the trigger, the thug is twisting to move away, but its just too late, as the finger is squeezing at that very same instant.
The guy would be alive if he didn’t assault the victim, and rush in on him for the finishing beat down after the blind side ambush.
Knowing the violent tendencies of certain people, its just good advice to just mind your own business. Even saying hello and smiling to some people can get you killed.
Wise man.
Just wild-ass speculation. Getting thrown down is not sufficient justification to kill someone.
Deadly force is not the standard.
It is deadly force or threat of serious bodily harm.
A violent shove to the ground can certainly cause serious bodily harm: Broken hips or femurs can cause strokes or severed femoral arteries, compressed spine can cause lifelong pain or paralysis. As Manuel OKelley said striking the head on the ground can cause a concussion and intracranial bleeding that can be a quick death or irreversible brain damage.
The shooter may be an A-hole but I see this as a justified self defense shooting.
here’s a bunch of videos and articles for your purview. You’ll see that someone being jumped by surprise can kill them (or get them killed)
I hate HOA’s. What makes you think I support them? I would rather live in a cardboard box in an alley than in a HOA development!
Right, the follow up , closing in for the kill while he is in a vulnerable position is the tell that he’s about to be destroyed for the crime of daring to speak to someone.
I agree, but the sheriff was only reporting on what the law allows.
He was backing up to get a running kick at the mans head? turned around and suddenly saw the gun?
As I said I think both men were jerks. However the issue is that he killed a man without sufficient justification. He will be convicted. This handicapped parking policeman is going to do some hard time with some black dudes that will beat the crap out of him.
Hard to speculate. The thug’s movements were ambiguous.
If he were really in retreat, rather than merely reacting and repositioning, his thug hands would have gone up in the air, and his thug feet would have kept putting distance between him and his victim.
“and his thug feet would have kept putting distance between him and his victim.”
Nope, that would mean leaving his wife at the mercy of the gunman who was just arguing with her.
exactly, hands up don’t shoot! didn’t they pratice this for a while after michael brown?
“A shove to the ground is not deadly force, “
Meaning to say that _being shoved to the ground_ does not justify deadly force after the fact. Not saying that it cannot kill. However, the fact remains, that even though the shove could have made him hit his head, THAT shove didn’t. You cannot shoot as he backs up because his shove COULD have done that.
If he moved towards him again, he could probably shoot.
He screwed up. Now he will be charged.
One thing I know I wouldn’t do is commit assault and battery.
He did not have a just cause to put his hands on the shooter.
It may be a valid shoot but the shooter created the situation. Broke every rule of CCW. One wonders if Drejka would have been so confrontational if he was not armed.
First rule of surviving in the jungle (for me at least) is not to bring attention to oneself.
To your second point if youve had surgery and are using a cane your doc gives you paper work to get you card
