Hard to speculate. The thug’s movements were ambiguous.

If he were really in retreat, rather than merely reacting and repositioning, his thug hands would have gone up in the air, and his thug feet would have kept putting distance between him and his victim.

I'm not berating you. I'm speculating. The video looked like the attacker was going for a second shot (kick) and suddenly realized oh oh I f’d up! but it was a split second later the gun went off. not a whole lot of time between the dude on the ground thinking “I'm on the ground and this guy is gonna kick my head in” .. and “shoot him!”.
