Traitor Roberts would likely become the swing vote.
What has Roberts done besides Obamacare that makes him a swing vote?

Souter is another one that needs replacement by one more likely to be and continue to be a Constitutionalist.

I’ve read that Thomas is considering retiring and that he has no intention of dying in his seat.

Putting oung conservatives on the Bench is dangerous. They may not have matured, got sufficiently in the habit of their Constitutionalism and then “grow in office.” Growth in office is unidirectional. It seems to be a clause in Natural Law that a leftist cannot move to the right when elevated to the Bench.

He is rated closest to the Rats with Kennedy gone. Plus he likes to reach across the aisle.

Roberts’ quitting would not be “taking one for the team.” A few decades ago he would have been praised by the MSM and Larry Tribe for having “grown in office.”

Does she have to leave the Court just because she has died? Has that status already been attained?
To: Flaming Conservative
Kennedy? No. His goal in a case is to be the deciding vote, to make waves with it and to gain adulation.

Leftists don’t have enough functional gray cells to “mature in office.”

I have long waited for the Court to declare an actual clause or article of the Constitution to be unConstitutional. There is enough precedent for it with the Colorado Court and the State Constitution to tenuously hang an argument on for Justices determined to do it.

BINGO!...sometimes it pays to have an open mind...(per your note)

Souter was not noticed a hell of a lot on the Court and his retirement might well have been missed by many.

She has, by hanging on for a replacement by Mrs Bill, lost her ability and the time to “spend more time with her family.”
