California has become the first state to adopt a "yes means yes" standard for sexual encounters. The law "would require 'affirmative, conscious, and voluntary agreement' by each party to engage in sexual activity."
And not just at the outset of the tryst, as this article in the Washington Post explains:

I have sons and grandsons-——this is insanity. They could become targets and once an accusation is made it sticks,whether it’s valid or not.

Consent it invalid unless it is informed. So there needs to be full written disclosure by both (all) parties prior to the consent.
I would also recommend that the entire transaction be videotaped so that there is evidence of continuing consent and lack of revocation.
You probably also need blood alcohol readings to show that the parties were competent to consent at the time of the contract and during its performance.

If at any time within 30 days of the encounter she regrets having had sex with the man (either because her girlfriends think he isn't cute enough, or she finds out he is a Republican, or that he doesn't agree with her on one issue or another, or her parents were upset that she had sex with the guy, or she changes her mind and thinks it really wasn't a good idea after all, etc....
then it must be considered rape.

This law only applies to an encounter between a male college student and a female college student.
The law DOES NOT APPLY in the following situations:
Either is not a college student.
Both are the same sex.
