The 1st Amendment? Why yes, press, speech, and religion. But so too are the 2nd, 4th, and 5th. The 6th and 7th aren't absolute. If you consider what the various agencies commit against the average citizen, the 8th is debatable. The 9th and 10th haven't existed for 50 years.
If it was at all advantageous for Obama to put soldiers in my bedroom, the 3rd would be gone.

My position is that every single one of our rights is under attack at all times. The only variation is to what degree. Think about it for a minute. The government is (has become) all about power and control. The founding fathers knew this. Government is a negative function - preventing you from doing things.
If the government would never infringe upon our rights and we could count on the men and women running government to always look out for us ... then why did the founding fathers feel the need for the Bill of Rights? Why would we have to expressly forbid the government from infringing upon these rights?
Because everyone who thinks about it for more than 30 seconds realizes they would if they could. They want to, some in government desperately, fervently hope to be able to stomp on some or all of them, but they can't blatantly do so because of the BoR. But the government - those in power and control for now - are always trying to expand their power and control. Our rights are under continual attack in ways big and small. They may have the best of intentions (or not), but in reality we are best served long term and as a whole by freedom and liberty. Not more government interference and control.
