The American Patriot Foundation is pleased to announce that LTC Lakin has repositioned his forces, has retained new legal counsel, and is extremely grateful that the Foundation will be dedicating the critical next few weeks before his planned court-martial on November 3-5, to focusing entirely on public affairs, strategic communications/messaging and coalition-building and that their support will continue seamlessly as the new attorney prepares for trial.
The website of the Foundation is being re-designed to reflect this new focus and emphasis. Contrary to the impression left by some blogs and internet commentary, LTC Lakin is consistent in continuing on the same path that he announced publicly six months ago when he released his first YouTube video-- and consistent with his military training, to continue to request assurance from Pentagon leadership that his military orders, including his deployment orders to Afghanistan, are legal-- authorized at the highest level by a Commander-in-Chief who is Constitutionally eligible, per Article II, Section 1 of the U.S. Constitution. As a medical officer and not a lawyer or Constitutional scholar, LTC Lakin is not laying claim to be the sole arbiter of the President's Constitutionality in attempting to determine, without any genuine evidence to make such a determination, the President's "natural born" citizen status. The burden of proof rests solely on Barack Obama to demonstrate to the American people and to the U.S. Armed Forces that he commands, that he is lawfully serving in his current capacity as head of the Executive Branch of the federal government.
The Army prosecutors have made this determination of the Commander-in-Chief's eligibility under the Constitution impossible-- by denying discovery- and essentially denying LTC Lakin the customary due process rights that defendants in American courts enjoy when facing criminal charges, and in LTC Lakin's case, a jail sentence of several years at Fort Leavenworth prison.
The Foundation is pleased to continue to support LTC Lakin, a decorated and outstanding officer with 18 years of service in the Army, as he persists in his pursuit of the truth, the rule of law, and in support of his sworn oath to uphold the U.S. Constitution. Terry is gratified by the many people who have stayed in constant touch with him through the website and deeply appreciates their support, their guidance and suggestions, and their prayers.

As he should. Repeatedly cases have been not heard due to lack of standing. If a commissioned officer does not have standing, then really who does?

I am a staff weenie (combat support) not a combat arms type. I doubt I will ever again inhabit a foxhole. I will most likely be found at a Tactical Operations Center TOC or another HQ location.

I want to see it cleared up with transparency as well, but until the Army Court of Appeals, the Court of Appeals for the Armed Forces or the United States Supreme Court rules that, as a matter of law, Dr. Lakin is entitled to the information because it’s relevant to his claim that the order was not lawful, he’s WAY behind the 8 ball. The Military Judge won’t put herself out on that limb because the answer is not clear-cut.

Thank you, sir. There’s a process that will, hopefully, be followed. That process is in place for a reason. No particular set of facts should overcome the constitutional process.
The court has already ruled that the orders that he received were legal and that Obama’s status is not relevant. Courts have a silly little habit of only dealing with the issue put before them. In this case, the issue was Lakin’s refusal to obey deployment orders from his immediate superiors. Courts are not going to allow a fishing expedition on some political point not germane to the charges. Many have tried to do this before and, as far as I know, none have never succeeded.
Lakin deliberately disobeyed deployment orders specifically for the purpose of getting the military or appeals courts to take on the political issue of eligibility. Military professionals don’t think that serving officers should engage in this kind of political activity.
More fluff! Sorry, but for most of American history active soldiers and sailors have taken political stances. Just ask Robert E. Lee.
You have mixed the issues. Obama wears two hats, one of a politician and one of the CinC. LTC Lakin could likely not care less about the former, but consistent with their oaths all serving officers should have an interest in whether the nations CinC holds a valid commission.
Hence my second question to jagusafr in #23 above; in essence, aside from political devices, how does a military officer honor his oath when he has probable cause to believe his chain of command is corrupted and that chain brushes off his concern?
I haven’t mixed the issues. This is a political issue that should be resolved by the political process. Its a sad state of affairs that this question was allowed to remain unasked throughout the nomination and election process, politicians all afraid to be accused of racism I suppose. Whatever the reason, they punted. We should express our opinion of this at the ballot box.
I’d recommend that you go back and study your history. Colonel Robert E. Lee, United States Army, was offered command of the Union Army. He refused, resigned his commission, and returned to his home state of Virgina a civilian. He was offered a commission in the Confederate States Army, which he accepted. He never served in political office. Thanks very much for helping me make my point.

I am a “military professional” of field grade rank. I don’t have a problem with what LTC/Dr. Lakin is doing. This transcends simple politics.
It makes our side look worse than desperate. We should focus on the issues.

1) That grand military tradition, the Memo For Record. Make one, keep 2 copies, wait for the proper time.
2) The IG - confidential and fairly effective, depending on the people investigating
3) Congressional complaint - I know, you said “corrupted”, but sometimes there’s value in the political aspirations and machinations of others. Regardless of the “others’” motivations, the truth can get out.
All suggestions are based on long (and occasionally painful) personal experience. It all comes down to doing the right thing in the right way, at the right time, for the right reason.

I’ll take the word of the Governor of Hawai’i, the Attorney General of Hawai’i, the Director of Health of Hawai’i, the Registrar of Vital Records of Hawai’i that Obama was born there.

You know, during the campaign of 2008, I was actually in the mainland campaigning for Senator McCain. This issue kept coming up so much in the campaign, and again I think it’s one of those issues that is simply a distraction from the more critical issues that are facing the country. And so I had my health director, who is a physician by background, go personally view the birth certificate in the birth records of the Department of Health, and we issued a news release at that time saying that the president was, in fact, born at Kapi’olani Hospital in Honolulu, Hawaii. And that’s just a fact. And yet people continue to call up and e-mail and want to make it an issue.
