This is outrageous:
The Federal Election Commission has taken the legal position in the Berg case that Berg, as a voter, does not have STANDING to challenge the constitutional qualifications of a presidential candidate.
Further, the FEC is taking the position that the FEC itself does not have an oversight role as to the constitutional qualifications of a presidential candidate.

If a voter may not legally challenge Obama’s qualifications under the Constitution, and the FEC may not legally challenge Obama’s qualifications under the Constitution, then WHO has the legal right to do so?

Berg is a citizen and the President is employed by the U.S. people. Berg or any U.S. citizen has standing and a right to demand documents to insure that the Constitution is overturned by some petty thug from Kenya.

On African Press International, I'm honestly just tired of it. I do not believe that the tape exists and, if you've read over the past few days, I was disappointed in myself for not trusting my gut feeling in the first place. Still, if my gut is wrong, I'll be more than happy to own up to it. Berg, it seems, is far more certain.
"We are working with computer people and Chief Editor Korir over at African Press International as we speak so the audio file can be transfered over to us for distribution," Berg said. "They say the information on there is far more extensive than just the things they reported, but before I do anything with it I want to review it in full."
As I've mentioned time and time again, it reminds me of the purported pictures of Bill Clinton allegedly burning an American flag in Moscow which never surfaced. It reminds me of the so-called "whitey" videotape of Michelle Obama which has never surfaced. It just doesn't smell right, I don't like that I'm even covering it, but I feel as though it's relevant to the discussion.
Look yes its written in stone (the US Consitution) as to what the requirement is. However there is no requirement to actually produce documentation that one is indeed elgible for the Presidency.
Again the honor system worked up until this election cycle....
There must be some sort of law saying that if you knowingly represent yourself as something and then take money (500m) for it, but are not that something it is illegal for you along with your co-conspirators.

This makes no sense to me.

I don’t think that was the issue—Bill Clinton was probably illegitimate too. Fathers of illegitimate children always conveniently “die”.
Even if his mom and Obama claimed to be married, as you correctly point out, it is a legal impossibility since polygamy is not legal in the US.
I don’t think being illegitimate would be sufficiently “embarrassed”. I don’t support him because he’s an incompetent Marxist boob with shady puppet masters but I wouldn’t hold his illegitimacy against him.
At this point, my attitude is “Screw what’s legal! I want to know what’s true!” Legal standing in a court be damned, 0bama needs to be held accountable for showing America that he’s eligible to be their/our leader.
I’d absolutely love it if an ICE agent arrested him and tried to deport him.

To answer your question...when the controversy first started a fake “certificate of live birth” was posted on the Daily Koz, and then challenged by bloggers all over the internet, and another similar phoney document was posted on an Obama website and it has been hammered by bloggers as well. The Obama campaign got their friends at factcheck.org to say that this second posted document was examined and found authentic. The Obama campaign and the media then ignored the issue completely.
That is why Berg had to file his lawsuit. The idea was to simply say to Obama “show us the birth certificate and we will go away.”
The “certificate of live birth” is not a birth certificate, and the certificate offered was a forgery anyway.
Speculation on why Obama refuses to produce this simple document center on a few ideas....maybe he was not born in the US, but Kenya...maybe his father was not who he says he was...maybe the document might have some other embarassing information.
Berg’s lawsuit also proposes that if Obama was, in fact, born in Hawaii, there might be other issues that make him ineligible under the constitution....he moved to Indonesia as a child and surrendered his US citizenship and never re-established it...or perhaps his mother did not satisfy a more obscure requirement that she be “of age” and then having left with him to Indonesia he again lost or never really had US citizenship.
I may have the details a little off, but you can get the general idea.
