The Civil War is about to loom very large in the popular memory. We would do well to be candid about its causes and not allow the distortions of contemporary politics or long-standing myths to cloud our understanding of why the nation fell apart.
The coming year will mark the 150th anniversary of the onset of the conflict, which is usually dated to April 12, 1861, when Confederate batteries opened fire at 4:30 a.m. on federal troops occupying Fort Sumter. Union forces surrendered the next day, after 34 hours of shelling.

Slavery was reprehensible in both the north and the south. However, it was the south which not only continued to maintain slavery, but abandoned the Union so that they could continue slavery forever.

After explaining the object and the rational for their objection to what congress did with the Alien & Sedition Acts, the bottom line was the following.
""That the good people of this commonwealth, having ever felt, and continuing to feel the most sincere affection for their brethren of the other States; the truest anxiety for establishing and perpetuating the union of all; and the most scrupulous fidelity to that Constitution, which is the pledge of mutual friendship, and the instrument of mutual happiness, the General Assembly doth solemnly appeal to the like dispositions in the other States, in confidence that they will concur with this commonwealth in declaring, as it does hereby declare, that the acts aforesaid, are unconstitutional; and, that the necessary and proper measures will be taken by each, for cooperating with this State, in maintaining unimpaired, the authorities, rights, and liberties, reserved to the States respectively, or to the People."It was a petition to the other states, not a call for insurrection!
"That the Governor be desired, to transmit a copy of the foregoing resolutions to the executive authority of each of the other States, with a request that the same may be communicated to the Legislature thereof; and that a copy be furnished to each of the Senators end Representatives representing this State in the Congress of the United States."
You will also note the following passage in the 2nd paragraph of the Resolution.
"The General Assembly most solemnly declares a warm attachment to the union of the States, to maintain which, it pledges all its powers; and that for this end, it is their duty to watch over and oppose every infraction of those principles, which constitute the only basis of that union, because a faithful observance of them, can alone secure its existence and the public happiness.It says that they are devoted to the Constitution and to preserving the Union under that Constitution.
And then I give you this... a very strong condemnation of the idea of unilateral secession and a repudiation of the early (1830s) revisionists who claimed both Madison and Jefferson in there resolutions of 1789 allowed for unilateral secession. Mr. Madison's letter to Nicholas Trist on December 23, 1832.

Dr. Sir I have received yours of the 19th, inclosing some of the South Carolina papers. There are in one of them some interesting views of the doctrine of secession; one that had occurred to me, and which for the first time I have seen in print; namely that if one State can at will withdraw from the others, the others can at will withdraw from her, and turn her, nolentem, volentem, out of the union. Until of late, there is not a State that would have abhorred such a doctrine more than South Carolina, or more dreaded an application of it to herself. The same may be said of the doctrine of nullification, which she now preaches as the only faith by which the Union can be saved.
I partake of the wonder that the men you name should view secession in the light mentioned. The essential difference between a free Government and Governments not free, is that the former is founded in compact, the parties to which are mutually and equally bound by it. Neither of them therefore can have a greater fight to break off from the bargain, than the other or others have to hold them to it. And certainly there is nothing in the Virginia resolutions of 98, adverse to this principle, which is that of common sense and common justice. The fallacy which draws a different conclusion from them lies in confounding a single party, with the parties to the Constitutional compact of the United States. The latter having made the compact may do what they will with it. The former as one only of the parties, owes fidelity to it, till released by consent, or absolved by an intolerable abuse of the power created.In the Virginia Resolutions and Report the plural number, States, is in every instance used where reference is made to the authority which presided over the Government. As I am now known to have drawn those documents, I may say as I do with a distinct recollection, that the distinction was intentional. It was in fact required by the course of reasoning employed on the occasion.
The Kentucky resolutions being less guarded have been more easily perverted. The pretext for the liberty taken with those of Virginia is the word respective, prefixed to the rights &c to be secured within the States. Could the abuse of the expression have been foreseen or suspected, the form of it would doubtless have been varied. But what can be more consistent with common sense, than that all having the same rights &c, should unite in contending for the security of them to each.
It is remarkable how closely the nullifiers who make the name of Mr. Jefferson the pedestal for their colossal heresy, shut their eyes and lips, whenever his authority is ever so clearly and emphatically against them. You have noticed what he says in his letters to Monroe & Carrington Pages 43 & 203, vol. 2,1 with respect to the powers of the old Congress to coerce delinquent States, and his reasons for preferring for the purpose a naval to a military force; and moreover that it was not necessary to find a right to coerce in the Federal Articles, that being inherent in the nature of a compact. It is high time that the claim to secede at will should be put down by the public opinion; and I shall be glad to see the task commenced by one who understands the subject.

As for today's situation where the Federal Government is overstepping its bounds in countless way that make the Alien & Sedition Acts seem almost trivial by comparison, perhaps it is time for a number of states to stand up and develop a modern day version of the Virginia Resolution. I'm all for it. Sadly, States today are controlled by docile little piglets busy sucking on the Federal teet.

They may have been free but they were not soldiers, not in the eyes of the state of Louisiana or the Confederate government. It it is an undeniable fact that the enlistment of blacks into the ranks of the Confederate army as combat soldiers was illegal until March of 1865.
And they supported the Confederacy, at least for a time.
Until they were told to go away and stop pretending they were real soldiers.

Now, you are bending the meaning of "soldier" to exclude non-combat arms. Go tell a truck driver in the US Army that he's not a soldier, and see how that flies. I'd pay real money to see that. Like I said earlier, you argue like a liberal.
