Actually, to split a hair, evolution is a "fact." A fact is something that is either true or false, as distinguished from an opinion. Evolution, indeed, the entire materialist view of life, is either true or false; therefore, it is a "fact."

I beleive that creationism violates the liberal commandment: "Thou shalt have no other god ahead of atheism and secularism."
For anyone truly and objectively interested in evolution v. creation in science, the evidence for creation is so ridiculously overwhelming, that it's next to laughable to overrule creationism for evolution.
Most people are sheep and treat the matter as they do their favorite teams in sports. That, intellectual laziness, is the real root and crux of this issue. That and anti-christian thought and political expedience.

The only religious belief that can't be questioned today is the evolutionist's belief that there is no God. They are as insistant as the Wahabi Muslims that they have the only correct doctrine of the origin of life, and they are just as intolerant of other beliefs. Unless they have videos of the late Carl Sagan's "billions and billions of years" of evolution, they are promoting a theory, not a fact. But I guess this one judge's ruling makes them feel better after the recent poll showed that after the last 50 years of indoctrinating US students to believe in evolution, a majority of Americans still don't buy it.

That's the wrong warning. Here's the warning which is needed:
The theory of evolution is part of the radical gay/lesbian agenda and can lead to homosexual behavior. Studies indicate that most of the people pushing evolution are homosexuals.
What people think "theory" means in science, and what it actually means in science, are two very different things.
Gravity, for example, is only a "theory."
Thermodynamics--which many creationists claim "proves" the "theory" of evolution is impossible--is, in itself, only a "theory."
God created evolution...what's the problem?
It is absolutely beyond doubt that species evolve over time, adapting to the changing environment and sometimes even becoming new species. We know this because we can have observed it. The common descent of all living organisms is also beyond doubt, verified by an overwheliming amount of evidence in the fields of genetics, palentology, embryology, and many others. We also know that genetic mutation, recombination of genes, and natural selection are all key to the process.
Religion, or more precisely, misinterpretation of the Bible, is the only grounds upon which anyone can reject these facts. Ergo, the judge is correct in his ruling.
The theory part is the precise mechanism of how this work. We know that species evolve. And we have good idea of how it works. We don't know the details.
Just like gravity. We know masses attract each other. We don't know precisely how or why this happens, though we have a good idea (general relativity).
Christian Literalism doesn't belong in science books. The proper place For teaching the Genesis myths is in Sunday School.
I am a Darwinist, but even I don't see what the big deal is. If a locality wants to put a sticker on their health books that "Babies come from storks" so be it.
