Fla. mom gets 20 years for firing warning shots

CBS News) JACKSONVILLE, Fla. - A Florida woman who fired warning shots against her allegedly abusive husband has been sentenced to 20 years in prison.

Marissa Alexander of Jacksonville had said the state's "Stand Your Ground" law should apply to her because she was defending herself against her allegedly abusive husband when she fired warning shots inside her home in August 2010. She told police it was to escape a brutal beating by her husband, against whom she had already taken out a protective order.

CBS Affiliate WETV reports that Circuit Court Judge James Daniel handed down the sentence Friday.

Under Florida's mandatory minimum sentencing requirements Alexander could receive a lesser sentence, even though she has never been in trouble with the law before. Judge Daniel said the law did not allow for extenuating or mitigating circumstances to reduce the sentence below the 20-year minimum.

"I really was crying in there," Marissa's 11-year-old daughter told WETV. "I didn't want to cry in court, but I just really feel hurt. I don't think this should have been happening."

Thompson was charged with Aggravated Assault. Some states define Aggravated Assault as, inter alia, threatening the use of deadly force that is reasonably comprehended by the victim as a threat of deadly force, coupled with apparent ability. To legally threaten the use of deadly force one must be legally justified in the actual use of deadly force. The moral is never, ever fire a warning shot. It’s like shooting someone in the arm or leg to disable them-no court will entertain the assertion that deadly force was not used.

Even still, it was confined to family and nobody was hurt. She should not even see prison IMO.

If you're referring to the woman in the original post, someone linked a copy of court documents that paints a VERY different picture than what the libtards are claiming, and pretty well justifies a prison sentence.

Actually,justice might be better serrved if people just let the judges give those un constitutional instructions,AND THEN IGNORED THEM.

Jurors DO have the right and duty to judge the law as well as the defendant in EVERY case.

IMO it's more like the media doesn't know, or care, what the truth is. They'll publish the story they want, and whatever they are reporting about is merely a means of getting their desired market to pay attention.

This is squared for any legal story. They can't report those accurately save by accident. Reporters and editors are simply clueless.

Plus Florida law really is that bad. This might be an accurate story, but there just isn't any way of determining that without going to legal blogs covering Florida trials.

As an example, there might be a racial angle to this. The Zimmerman trial proves that happens in Florida.

This is the left and MSM trying to gen up more racial animus.

Here you have a black woman who they say did nothing more than shoot into a wall, as a warning, and she gets 20 years. And yet George Zimmerman who is not black, kills a black man using the same defense (they say) and he goes free.

When what actually happened in this 2-3 year old story is that this woman voluntarily went to the guy’s house and stayed the night. They ended up arguing, and although the guy treated her badly and physically blocked her getting to the bathroom, she was no angel.

She ultimately went outside, and could have left, but instead, she got her gun, went back in and tried to shoot the guy. Well, she missed and gets arrested and the guy then gets a restraining order against her.

If I understand this correctly, she then comes back later and starts more arguing. Then she goes out and gets a gun once again, fires what she calls a warning shot and ends up in jail and tried for it.

Both times when she shot, there were children in the house, and so they were in danger from her firing the gun.

But make no mistake, this is the MSM and the left trying to dig up old stories to make the Zimmerman verdict look back and gen up racial violence.

The black Congresswoman from Orlando was really upset over this case as Corey overreached in her prosecutions of this black woman.

But Corey met with her and put her heart to rest telling her that she will make it right by overcharging some white man for getting beat up by a black thug and that will balance things out.

glad i prefaced if her story was true.

you don’t leave and come back in tostart shooting. you have just become the aggressor and a willing participant. a well taught ccw person knows these basic, fundamental prinicples.

They were arguning. She left, got her gun, returned and fired at him. She was offered a plea of 3 years, rejected it, bet the farm on SYG, and lost. Mandatory sentencing
