A House measure that would allow those with a concealed carry license to ignore no gun signs is headed to the Ohio Senate.
Termed the Decriminalization Effort for Ending Notorious Deaths Act by its sponsor, HB 233 states that members of the military or those with a carry permit would not be guilty of violating most areas deemed gun-free. The measure passed in a Republican-heavy 65-31 vote on Thursday.
The bill decriminalizes so-called gun free zones for concealed handgun license holders, said bill sponsor, Rep. John Becker, R-Clermont.
The proposals language protects CHL holders and military members found carrying a weapon in a gun-free zone from arrest and prohibits law enforcement from seizing their guns or ammunition. However, if asked to leave they must comply under threat of a fourth-degree misdemeanor criminal trespass charge, which can result in 30 days in jail and fines of up to $250.
The bill also removes daycares from the list of places that must post gun-free zone signs and modifies posting requirements for airports and government buildings, as well as decriminalizes carrying firearms into a liquor establishment.
The Ohio Chamber of Commerce, Ohio Coalition of Battered Women and the Ohio Restaurant Association joined gun control groups in testifying against the bill in committee this week.
The state representatives that voted for this bill should be ashamed of themselves, said Maureen Washock with Moms Demand Action in a statement. This legislation would undermine private property rights by allowing people to bring hidden, loaded handguns onto private property even if the owner has posted a no-guns-allowed sign.
The bill has the backing of local and national gun rights organizations.
Now in the state Senate, where the GOP controls three out of four seats, a successful vote there would send the measure to Republican Gov. John Kasich for consideration. Kasich was endorsed by the National Rifle Association in his 2014 reelection and proclaimed his support for the Second Amendment in his bid for the White House last year.
The Constitution applies EVERYWHERE, as do our Constitutional Rights.

A business owner has a right to post those signs but he doesn’t have a right to ruin another man’s life over them. That’s how I see it. This law is reasonable and just.
Do you expect Kasick to not veto it? Do you think the legislature would override the veto? That's the way things roll in Ohio.
I don’t know. Seems like we have made a lot of progress over the past 4 years or so. Look at the recent bill regarding suppressors and background checks for instance. I think it will pass to be honest.

But, taking it further, any business/citizen who in any way causes a CHL customer to face unwarranted legal consequences shall be held liable for all legal costs and damages.

That’s correct. The property owner can still ask them to leave,and the law requires that the CWP owner complies. The CWP only breaks the law if he doesn’t comply

except for federali property, K-12 schools, and metal detectors we already ignore KILL ZONE signs in Colorado.
You would think that a battered woman would be the first person to support this bill.
If I was a battered woman I would be carrying everywhere.
Which is why they kept the ability to ask someone to leave or be charged with criminal trespass. Seems like a positive compromise to me.

While I avoid most of them, private businesses have the right to make stupid decisions - just like they should have the right to decide whether or not to cater to homosexual "weddings" by decorating the cake a certain way.
I like that it allows one to ignore the sign unless asked to leave before anything can be done against the gun owner - as it is now (in a lot of States) they can call the law and lodge the complaint w/o talking to you first.
