When your own stick turns out to be a boomerang, or what happens when you step on your own rake ! The latest revelations in the ObamaCare debacle revolve around Obama architect Jonathan Gruber. You might remember back in 2010 during the fight over ObamaCare mandates ‘we the people’ were told the mandate was a penalty and not a tax. However, when ObamaCare challenges ultimately reached the courtroom the administration argument was exactly the opposite. The government argued the mandate was a tax not a penalty; only as a tax could the construct survive legal scrutiny. This latest Gruber development...

This week saw a major victory for attorneys who’ve argued that, according to the Patient Protection and Affordable Care Act, it’s illegal to give federal subsidies if insurance plans aren’t part of a state-based Obamacare exchange. The D.C. Circuit Court ruled that the legislation does not authorize such subsidies. Another court gave a somewhat muddled and mixed ruling on the matter that said such subsidies are ok, basically saying that Congress could have or would have been ok with it. The good news, for the attorneys fighting this battle, is that the mixed rulings make it more likely that they’ll...

UNKNOWN QUESTIONER:“Um, you mentioned the Health Insurance Exchanges for the States. And it’s my understanding that if the States don’t provide them, that the Federal Government will provide them.”M.I.T. economics Prof. Jonathan Gruber:“Yeah, so these Health Insurance Exchanges —once you go on MA-HealthConnect.org and CRS [is] in Massachusetts—will be these new shopping places. And they’ll be the place that people go to get their subsidies for health insurance. “In the law it says [that] if States don’t provide them, the federal backstop will. The Federal Government has been sort-of slow in putting in this backstop, I think partially, because they...

Many of you probably heard about the “Halbig” decision, in which a federal court struck a blow against Obamacare by ruling that the IRS was wrong to arbitrarily grant subsidies for health insurance policies purchased through a federal exchange. And why did the judges rule against the IRS? Well, for the simple reason that the Obamacare legislation specifically says that subsidies are only available for policies purchased through exchanges set up by state governments. My Cato colleague Michael Cannon explains: The PPACA authorizes the IRS to issue health-insurance tax credits only to taxpayers who purchase coverage “through an Exchange established...

Obamacare architect Jonathan Gruber said that lack of transparency was a major part of getting Obamacare passed because “the stupidity of the American voter” would have killed the law if more people knew what was in it. Gruber, the MIT professor who served as a technical consultant to the Obama administration during Obamacare’s design, also made clear during a panel quietly captured on video that the individual mandate, which was only upheld by the Supreme Court because it was a tax, was not actually a tax. “This bill was written in a tortured way to make sure CBO did not...

In a sense, Jonathan Gruber’s response today to the emergence of his 2012 explanation for the language in ObamaCare mirrors the attempt to get courts to ignore the plain text of the statute and instead rule based on the most current interpretation. The New Republic’s Jonathan Cohn reached out to Gruber to get his reaction to the emergence of the Nobilis video in which the architect of ObamaCare explains that the restriction of subsidies to states with their own exchanges was a rational attempt to coerce states into creating those exchanges, rather than shifting the burden back to the federal...

BEGIN TRANSCRIPT RUSH: Have you seen or heard the audio snippet of the actual author of Obamacare? His name is Jonathan Gruber. He is a professor at MIT, a professor of economics. He wrote both Romneycare and he wrote Obamacare. "Oh, yeah, he's a brilliant, smart guy! Oh, totally smart guy." Almost a year ago, in October of 2013, he was in Philadelphia speaking at the 24th Annual Health Economics Conference, and he spoke about Obamacare and how and what they had to do to make it a reality. I want you to listen to how this prominent Democrat, prominent...

The New York Times has an editor's note today: "On July 12, the Op-Ed page published an article by Jonathan Gruber, a professor of economics at M.I.T., on health insurance and taxation. On Friday, Professor Gruber confirmed reports that he is a paid consultant to the Department of Health and Human Services, and that his contract was in effect when he published his article. The article did not disclose this relationship to readers. "Like other writers for the Op-Ed page, Professor Gruber signed a contract that obligated him to tell editors of such a relationship". In November this blog, too,...

"Lack of transparency is a huge political advantage. Call it the stupidity of the American voter, or whatever, but basically that was really, really critical to getting the thing to pass." That was MIT economist Jonathan Gruber, one of the key architects of ObamaCare, explaining how ObamaCare was purposefully designed to obfuscate how it was financed, how the subsidies worked and other unpleasant features of the law. [snip] Gruber's comments, made at a 2013 conference but just now making the rounds on the Internet, are the polar opposite of what Democrats promised the public.

ObamaCare architect Jonathan Gruber said that lack of transparency was a major part of getting ObamaCare passed, and that it was written in such a way as to take advantage of "the stupidity of the American voter." On MSNBC Tuesday, Gruber told Ronan Farrow that he “spoke inappropriately” when he made the comments, which surfaced this week in an online video. “The comments in the video were made at an academic conference,” Gruber said. “I was speaking off the cuff and I basically spoke inappropriately and I regret having made those comments.”

“This bill was written in a tortured way to make sure CBO (Congressional Budget Office) did not score the mandate as taxes. If CBO scored the mandate as taxes, the bill dies. … So it’s written to do that,” Gruber said, suggesting “it would not have passed” if the law “made it explicit” that healthy people would “pay in” and the sick would get money. “Lack of transparency is a huge political advantage,” Gruber continued. “Call it the stupidity of the American voter or whatever, but basically that was really, really critical to get the thing to pass. I wish...

Via Newsbusters, after yesterday’s unpleasantness and the Halbig “speak-o†fiasco of a few months ago, I see Democrats (plus independents in name only like King) have finally reached the “Jon who?†stage of their Gruber problem. This is the game we’re playing now, eh? KILMEADE: They just lied about a health plan to the American people, called the stupidity of the American voter and bragged about the lack of transparency. KING: This is one guy. I don’t know who this guy was. All I know is that it’s important for people to have health insurance. And if you guys are...

Obamacare architect Jonathan Gruber said Tuesday that he regrets saying that aspects of Obamacare needed to be concealed from the public due to the “stupidity of the American voter.” “Do you stand by the comments in that video?,” MSNBC host Ronan Farrow asked Gruber, referring to a video of Gruber explaining how a lack of transparency helped Obamacare pass into law. “The comments in the video were made at an academic conference,” Gruber said. “I was speaking off the cuff and I basically spoke inappropriately and I regret having made those comments.” Farrow then argued on Gruber’s behalf that

"Let me say it as simply as I can: Transparency and the rule of law will be the touchstones of this presidency."Barack Obama, January 2009. See him say it for yourself. http://www.youtube.com/watch?v=J4AJ843ERnUThis is HUGE. It proves that Obamacare is premised on lies. And it proves more than that. Obamacare architect Jonathan Gruber: “This bill was written in a tortured way to make sure CBO did not score the mandate as taxes. If CBO scored the mandate as taxes, the bill dies. Okay, so it’s written to do that. In terms of risk rated subsidies, if you had a law which...

On the Kelly File tonight, there was a new video clip of Gruber from Oct 4, 2013, telling in another setting how they changed the wording to fool the stupid public. The White House distancing from Gruber, by refusing to acknowledge these videos. Trey Gowdy weighs in on the Gruber videos.

In addition to CBO, MIT's Jon Gruber has also done a study on premiums. And what does he conclude? He concludes, using Congressional Budget Office data, the Senate bill could mean people purchasing individual insurance would save every year $200 for single coverage and $500 for family coverage in 2009 dollars. Most people think he is one of the best outside experts. He has big computer models. He takes the CBO data and, in some respects, he has helped CBO by giving some information to CBO that it otherwise does not have. Mr. Gruber also points out that people with...

Yet another video has emerged of MIT professor and Obamacare architect Jonathan Gruber calling Americans “stupid,” and bragging about how the Affordable Care Act’s drafters had to deceive the public in order to pass the law. (snip) “But now tonight,” Kelly reported, ” more video has surfaced showing this was not the first time Mr. Gruber called the American people stupid in an ‘off-the-cuff’ remark. In this next clip from also last year, Mr. Gruber explains how Democrats played with the language of the Obamacare law so that it achieved their goals, by again, fooling the stupid public.” She then...

ObamaCare architect Jonathan Gruber said Tuesday he regrets saying that the health care law was written in a way that took advantage of the “the stupidity of the American voter,” adding he spoke “inappropriately.” The Daily Caller reported that the MIT professor, who served as a consultant to the Obama administration as it constructed the health care overhaul, told a panel at the University of Pennsylvania that a lack of transparency was essential to getting the law passed. “This bill was written in a tortured way to make sure CBO did not score the mandate as taxes,” he said. “If...
