Everyone needs to cool their heels on this Flynn dismissal order for a bit. While we are all very happy that the three-judge panel of the DC Circuit Court of Appeals ordered District Judge Emmet Sullivan to end his abusive treatment of General Flynn in its order Wednesday, it is a tad too soon to just assume Sullivan will simply accede to the order and dismiss the case. General Flynn himself is on with Rush Limbaugh confirming this is the case as I write this, in fact. Sullivan is clearly a tool of the deep state, and we must remember...

BREAKING: Newly Released Strzok Notes Implicate Obama and Biden DIRECTLY Ordering Sham Flynn InvestigationThe Justice Department released Peter Strzok notes from 1/4/2017 regarding the Flynn-Kislyak calls. Last month it was revealed 2020 Democrat presidential candidate Joe Biden was in a January 5, 2017 Oval Office meeting discussing General Flynn’s phone calls with Russian Ambassador Kislyak with Obama, Yates, Comey, Rice and Brennan. Now we know that Obama and Biden were directly involved in the sham Flynn investigation. Strzok’s newly released notes also suggest the secret Oval Office meeting on January 5 was the reason the Flynn investigation was not closed....

The three judges on the DC Circuit Court of Appeals have approved a writ of mandamus ordering Judge Emmet Sullivan to dismiss the case against Michael Flynn. [pdf here]The panel ruled 2-1, that U.S. District Judge Emmet Sullivan overstepped his authority in not accepting the unopposed motion and questioning prosecutors’ decision. This is a big victory for the Flynn defense team. Not sure what Sullivan will do now.Judges Karen Henderson and Neomi Rao supported the writ, judge Robert Wilkins did not. Henderson was the surprise vote.Writing the majority opinion Judge Neomi Rao noted, “in this case, the district court’s...

The director of the cable movie version of fired FBI chief James Comey’s book “A Higher Loyalty” flipped his lid after learning that the flick would air after the November election — and now ViacomCBS says it will reconsider the decision and move up the air date. Both Comey and the director, Billy Ray, said they were disappointed in the earlier decision to delay the flick, called “The Comey Rule,” the New York Times reported Tuesday. “I don’t understand why CBS would sit on a movie about important current events, and I hope the American people get the chance to...

Dear Judge Sullivan, Well, that just tears it, doesn't it? You were the god (small "G") of your courtroom. All powerful, take no guff. Throughout the process you were hard on both sides. Cheers alternated from the left and the right. I'll bet you figured when everyone was mad at you, you must be charting the right course. You were all set to mete out historic punishment, cementing your position in history and the A-list of party invites.

Former FBI director James Comey told President Obama that the 2016 conversations between Russian ambassador Sergey Kislyak and incoming national-security adviser Michael Flynn were not criminal in nature, according to notes from former agent Peter Strzok released by Flynn’s legal team. The page of notes was taken by Strzok appears to describe a January 5, 2017 meeting of President Obama, Vice President Joe Biden, and national security officials. This meeting occurred amid accusations that incoming Trump administration officials had colluded with Russian operatives. Strzok was not present at the meeting, and it is unclear what record of the meeting he...

A federal appeals court on Wednesday ordered a judge to grant the Department of Justice's (DOJ) unusual move to drop charges against former national security adviser Michael Flynn. A three-judge panel on the D.C. Circuit Court of Appeals approved Flynn's petition to intervene in the case after a district court judge had tapped an outside counsel to argue against the DOJ's move.

A U.S. appeals court on Wednesday directed a federal judge to drop the criminal case against President Donald Trump’s former national security adviser Michael Flynn as demanded by the Justice Department, preventing a judicial review of the propriety of the request. In a split decision, a three-judge panel of the U.S. Court of Appeals for the District of Columbia Circuit ruled in favor of Flynn and the Trump administration in preventing U.S. District Judge Emmet Sullivan from exercising his discretion on whether to grant the department’s motion to clear Flynn, who twice pleaded guilty.

In the latest twist, the Justice Department disclosed to a federal court Tuesday it has located a new page of notes from Peter Strzok, the former lead FBI agent in the Russia collusion investigation, that are exculpatory to former national security adviser Michael Flynn. Acting U.S. Attorney Michael Sherwin informed U.S. District Judge Emmet Sullivan of the discovery in a midday court filing, revealing the single page of notes were believed to have been taken by Strzok during the critical juncture of early January 2017 when FBI agents recommended shutting down their investigation of Flynn only to be overruled by...

A federal appeals court judge repeatedly asked Friday whether dropping the case against former national security adviser Michael Flynn would mean police can escape accountability for brutalizing black people. DC Circuit Judge Robert Wilkins raised the possibility as Flynn’s attorneys and the Justice Department pleaded with a skeptical three-judge panel to order US District Judge Emmet Sullivan to dismiss Flynn’s case and his 2017 guilty plea for lying to the FBI. Wilkins, an African American Harvard Law School graduate, asked whether dismissing Flynn’s case would mean that judges must also dismiss cases against police if prosecutors offer racist reasons.

At the end of the day, Judge Henderson may decide, based on the long and sordid history of this case, that it isn’t just Judge Sullivan’s amicus who is intemperate. Over the course of nearly two hours, a three-judge panel of the D.C. Circuit Court of Appeals quizzed attorneys for Michael Flynn, the Department of Justice, and Judge Emmet Sullivan. The questions posed during oral argument suggest the court is hesitant to order Sullivan to dismiss the criminal case against Flynn — at least at this time. How the court will rule, however, likely rests in the hands of Judge...

There is an old adage among lawyers: “If the facts are on your side, pound the facts; if the law is on your side, pound the law; if you have neither the facts nor the law, pound the table.” John Gleeson, the attorney and retired federal judge who was appointed by U.S. District Judge Emmet Sullivan to argue that federal prosecutors should not be permitted to dismiss their case against former National Security Adviser Michael Flynn, is using a sledgehammer to pound paper. On Wednesday, Gleeson filed a 72-page brief (an oxymoron, to be sure) that was stunningly feeble on...

A former judge appointed to oppose the Justice Department’s request to drop its case against Michael Flynn urged sentencing to move ahead in a court filing Wednesday, arguing the government’s request to dismiss the case has only “pretextual” justification. Ex-Judge John Gleeson said in a DC federal court filing that “[t]he facts surrounding the filing of the Government’s motion constitute clear evidence of gross prosecutorial abuse. They reveal an unconvincing effort to disguise as legitimate a decision to dismiss that is based solely on the fact that Flynn is a political ally of President Trump.”--- U.S. District Court Judge Emmet...

Oral arguments are set to take place this week, when U.S. District Court Judge Emmet Sullivan will have to explain why he has not signed off on the Justice Department’s motion to dismiss its case against former National Security Adviser Michael Flynn. The hearing marks another extraordinary turn in an extraordinary -- and seemingly interminable -- case that has brought pressure upon both the Justice Department and the judge overseeing it. After calling into question the DOJ’s choice to drop Flynn’s prosecution, Sullivan is now in the position of defending his own decision. ~snip~ Rule 48(a) of the Federal Rules...

WASHINGTON - The Justice Department’s conduct in abruptly deciding to end the case against President Trump’s former national security adviser Michael T. Flynn was so unusual that it raised a “plausible question” about the legitimacy of the move, a lawyer for the trial judge overseeing that case told a federal appeals court on Monday. In a 36-page filing, the lawyer for Judge Emmet G. Sullivan of the United States District Court for the District of Columbia asked a three-judge panel not to cut short his review of the factual and legal issues surrounding the case. A defense lawyer for Mr....

Judge Emmet G. Sullivan should not be required to act as a “mere rubber stamp” for the government’s unusual move to undo the guilty plea of President Trump’s former national security adviser Michael Flynn, the judge’s lawyers told a federal appeals court in Washington on Monday. Sullivan’s attorneys asked the appeals court to stay on the sidelines to give the judge an opportunity to ensure the “integrity of the judicial process” and to rule on the Justice Department’s request to dismiss Flynn’s case. The judge must evaluate Flynn’s dramatically different claims, Sullivan’s lawyer Beth Wilkinson told the court: “What, if...

The hired lawyer for Judge Emmet Sullivan has filed a response to the DC District Court order in the case against Michael Flynn. [pdf available here] The DC district court ordered Sullivan to explain why he would not allow DOJ to drop charges against Flynn; the response by Sullivan’s lawyers says the DOJ position is essentially a moot issue, and Flynn can defend himself against independent accusations by the court.
