    Robert Bork, a Reagan administration nominee whom the U.S. Senate refused to confirm, called the federal legislation signed by President Bush early Monday morning something that "happens with some regularity."

    "[The new law has] given jurisdiction to a federal court to hear, in effect an attack upon a state court outcome, but we do that all the time," said Bork, who authored the 2003 book "Coercing Virtue: The Worldwide Rule of Judges" and is currently a distinguished fellow at the conservative Hudson Institute.

    "They (the Congress and the president) are not overstepping their legal bounds, they have a right to confer jurisdiction on a court," Bork said, just hours before a federal district court was due to hear the Schiavo case.

    "Federal habeas corpus is precisely that. Somebody is convicted in a state court, exhausts his appeals and then files a writ of habeas corpus in a federal court in order to challenge the constitutionality or otherwise of his trial. So this is not a unique intrusion into state court jurisdiction," Bork added.

    Bork also dismissed the argument that congressional conservatives and President Bush were being hypocritical by expanding the role of the federal judiciary. "The hypocrisy is the other way. I think what the Democrats see is once you talk about life in this way, you are tangentially or obliquely raising the abortion issue. I think that scares the hell out of them," Bork said.

    "They don't want to view life as anything -- unless it's the death penalty of course. If somebody murdered somebody, they would be against giving them death but if it's an innocent unborn child or a Terri Schiavo, they are all for it," Bork added.

    He also emphasized that in his view, congressional action in the Schindler Schiavo case does not mean "trashing the constitution."

    "That's ridiculous ... This is an effort to use their undoubted power over jurisdiction," Bork said.

    'A fundamental right'

    Conservative legal scholar Mark R. Levin said Democratic liberals in Congress are upset because they are not in the position to affect what happens in the courts. "What really offends the Left is Congress asserting its constitutional power over a court, and not in service to the liberal agenda," Levin wrote in a posting on National Review Online on Monday.

    Levin, president of the Landmark Legal Foundation, also authored "Men in Black: How the Supreme Court is Destroying America."

    "The right to live, or more specifically, the right not to be killed, is a fundamental right. And it's a right recognized in our founding document, the Declaration of Independence," Levin wrote.

    "Article III specifically empowers Congress to determine the jurisdiction of the federal courts, which is all it did [Monday]. It authorized a federal court to determine whether Terri Schiavo's due process rights and the right not be subject to cruel and unusual punishment were properly protected by a state court," Levin added.

    He criticized liberals for failing to support the federal intervention in the Schiavo case when it has championed the Supreme Court's intervention in abortion law.

    "In Roe v. Wade, the Supreme Court decided on its own that abortion was a federal question, not to be left to the states, without any constitutional basis whatsoever. It pre-empted every state court and legislature (and Congress, for that matter). And the Left celebrates this decision," Levin wrote.

    Levin also warned conservatives not to be intimidated by political attacks over the federalizing of the Schindler Schiavo case.

    "We must not allow the Left to define the terms of this debate. It is willing to make almost any argument to protect the supremacy of the courts. And even though Congress here is instructing the federal courts to review the case, the Left objects to any congressional exercise of constitutional authority over the judiciary"

    ...But in the 24-hour-a-day TV coverage that now exists, the forces promoting defeatism have a far more potent weapon for magnifying everything that goes wrong, or only appears to have gone wrong. We who support World War IV can complain all we like about these conditions, but they are the ones under which it will have to be fought if it is to be fought at all. The bottom line is that we are up against even more defeatism in this war than there was in World War III.

    Before we entered World War II, serious doubts were raised as to whether we were a match for such disciplined and fanatical enemies as Nazi Germany and Imperial Japan. And in World War III, leading anti-Communists like Whittaker Chambers and James Burnham were sure that we lacked the stomach, the heart, the will, and the wit to stand effectively against the Soviet Union and its allies and sympathizers: to Chambers we were "the losing side," and to Burnham we were veritably suicidal in our weakness and folly. They turned out to be wrong because, as Charles Horner of the Hudson Institute once put it in speaking of Chambers, they, and not they alone, failed "to anticipate the resiliency of the American citizenry and its leadership."21 Today similar doubts and fears are once again all over the place, with even some of my fellow supporters of the Bush Doctrine murmuring that we have all grown too soft, too self-indulgent, and too self-absorbed to meet yet another daunting challenge.

    Except for an occasional twinge brought on by paying too much attention to the antiwar forces, and to certain aspects of our culture, both low and high, I did not share these doubts and fears before the verdict of November 2, and they have been quite banished by what I am persuaded the American people were saying when they voted to keep George W. Bush in the White House for another four years.

    Which is why I think (to say it one last time) that the amazing leader this President has amazingly turned out to be will—like the comparably amazing Harry Truman before him when he took on the Communist world—have the wind at his back as he continues the struggle against Islamist radicalism and its vicious terrorist armory: a struggle whose objective is the spread of liberty and whose success will bring greater security and greater prosperity not only to the people of this country, and not only to the people of the greater Middle East, but also to the people of Europe and beyond, in spite of the sorry fact that so many of them do not wish to know it yet."

    General Will Assess Iraqi Training, Not War Strategy

    WASHINGTON, Jan. 7, 2005 -- A retired Army general isn't going to Iraq to assess the effectiveness of U.S. warfighting operations there, but rather will evaluate efforts to develop Iraqi security forces, a senior Defense Department spokesman told reporters here today.

    Retired Gen. Gary E. Luck and a support team will soon go to Iraq "to provide some assessment of how we're doing" in training and fielding Iraqi security units, spokesman Lawrence Di Rita noted at a Pentagon press briefing.

    Luck, who advised then-U.S. Central Command Commander Gen. Tommy R. Franks during the Iraq campaign in 2003, was described by Di Rita as "an extraordinarily intelligent individual" who "knows an awful lot of what we're doing in Iraq."

    Iraqi police and military units have so far experienced mixed results in engagements against insurgents, Di Rita observed, noting "areas where the Iraqi security forces have performed well" and instances "where they've performed sub-optimally."

    Asked by a reporter to verify speculation that Luck will also assess the overall U.S. military strategy in Iraq, Di Rita replied: "That's not true; I mean, it's just not accurate."

    Luck is going to Iraq "to take a look at Iraqi security-force development," Di Rita said.

    "That's the mission," he reiterated, noting that the Pentagon has periodically sanctioned similar evaluations of how Iraqi security forces are being trained and used.

    "This is another one of those assessments," Di Rita noted.

    Iraqi security forces "are getting more and more involved in the security of Iraq," Di Rita said. He acknowledged the Pentagon's interest in keeping their training "on track" and "to see that they continue to perform to their utmost potential."

    Di Rita said he didn't know the full complement of Luck's support team.

    "Multinational forces and Iraqi security forces will continue offensive operations to ensure that conditions are set to support a safe and secure environment" for the Jan. 30 elections, remarked Army Brig. Gen. David Rodriguez, the Joint Staff's deputy director for operations, who accompanied Di Rita to the press briefing.

    Rodriguez also updated reporters on U.S. military support for tsunami aid in South Asia, noting that more than 13,000 servicemembers deployed to the region have distributed more than 365 tons of supplies. American aircrews have flown more than 450 rescue, recovery and supply missions to bring aid to tsunami victims, the general said.

    Here in Lee County, precinct 11, orderly, mostly seniors, only Dem. signs out front.

    Pastor at the church said he was asked to measure the distance from the signs to the building 10 times...Bush voters care!

    Phoned local GOP headquarters and was told that all the GOP signs were gone, that every time they were put up, they were being stolen. Cape Coral, someone in a yellow pickup was tossing Bush/Cheney signs in the back - and the witness helpfully provided a license plate number.

    Also, someone poured acid on a car, and blamed it on the GOP. Didn't ask details, sorry...but the Lee County GOP worker was calm, solid, would gladly provide details, I think.

    Worker shared a prayer, and reminded me that as long as signs were tasteful, it is still a free country and we can make (and guard) signs.

    Heading out with my Veterans for Bush - Cheney (in honor of my dad, and FRIends) (including the message in large black letters: DO NOT STEAL THIS SIGN!).

    Tomorrow I and my wife will vote for George W. Bush. Tonight, I heard on the radio that an Army soldier was killed in an ambush in southeast Afghanistan. My son is stationed in southeast Afghanistan. I checked Fox news and they have an article about a US soldier killed and two wounded in a patrol near Orgun. My son is on a patrol near Orgun. I do not care if it is him, tomorrow we will still vote for Bush. God bless America and God bless President Bush.
