It is unclear at this point whether the judge attended law school.

No. It is unclear at this point whether the judge attended GRADE school.

Federal judge in Denver rules that it violates free speech rights.

Total bullcrap. I own the phone, I pay for it, all the DNCall list does it give me a CHOICE to limit the type of calls allowed to come into MY PHONE.

I have "Privacy Manager" on BOTH of my lines. It basically says to the caller if you don't provide caller ID info, you don't get thru! Are these courts now going to make THAT illegal too?

The law does not prevent the telemarketers from speaking. However, There is no constitutional requirement that anyone has to listen. According to the 'logic' of this idiot judge, if I want to write a letter to the editor of the NY Times, they MUST print my letter since to not print it is a violation of my right to speak.

If instead of phoning me at 8:00pm they stood outside my window and called into my home, would that be any different? If I ask them to stop, they should stop and not claim free speech.

If they don't stop, there's always the 2nd Amendment:

No, maybe Congress should declare more federal tax on phone use by businesses if they generate a certain percentage of their overall business by phone solicitation.

What I don't understand is how the states that already had DO NOT CALL were functioning all this time. This new edict applies only to the national list. The individual states are not included in the new order.

They should amend the Constitution, legalize bills of Attainder for ONE DAY ONLY and have half the judiciary's heads on pikes by tomorrow at sunset.

That would work.

Because I don't have a mouthful of food when they ask me those questions...I'm setting aside time to answer those questions at my convenience...not theirs...after all I'm the customer. If I want it I'll ask for it… otherwise leave me alone!

The Judge's problem with the list is that it gives preferential exemption to charitable (and political) organizations.

Tax laws are preferential to charities and political campaigns too. Will this judge throw out the tax code?

And we could have a funeral persession come by your house every morning and block your driveway before you go to work. You can always ride your bike to work get around or there's always the bus at a very low price.

Require politicians & charities to observe the requirements of the no-call list.
