Good now maybe we can get down to the job of actually redistricting.

Any bill can be introduced and passed in a special session in Texas...

How so? Not arguing just trying to understand.....

Members in the Texas House or Senate file proposed bills with the clerk of their respective house. The Speaker (House) or Lt. Governor (Senate) then sends the bill to the appropriate committee and about hundred steps later (if all goes well) the bill is passed by both houses and goes to the Governor.

They saying goes that there are hundreds of ways a bill can die in the legislature, but only one way to pass it. In a special session there is simply one additional way to kill a bill, by raising a "point of order" that the bill is not authorized in the call of the special session by the Governor. A well founded point of order kills a bill, or at least send it back to point where it went out of order. Since a bill that is outside of the call is always out of order it would be dead.

Now that I think about it, it might be possible for the leadership to play a few games even in a special session. I was in the House Gallery in 1987 when a Republican raised a valid point order that a bill was not being brought up at its proper time (I don't recall why it had to be after or before a certain time, but it did). The Democrat Speaker, Gib Lewis, tried to ignore the member raising the point, but finally the shouts were too loud and he recognized him. The member made his point of order and Gib said:

"Oh yeah? Why don't you come up here and see what time my watch says. Overruled" (BANG went his 4' gavel)

Memories like make me contemptuous of Democrat cries about Republican heavy handedness. They're just pissed that they are not the ones banging the gavels for partisan advantage.

thanks I think we are in agreement... I was just taking you point of any bill can be introduced and passed and I guess it can. But it certainly would be in violation of the State Constitution..... Anyway no big deal either way....

When the Legislature shall be convened in special session, there shall be no legislation upon subjects other than those designated in the proclamation of the Governor calling such session, or presented to them by the Governor; and no such session shall be of longer duration than thirty days.

Folks, the media is the next line of Democratic defense if all appeals are exhausted. Right now, all national media outlets are preparing to interview the "courageous Dems." After the local and national media take turns attacking the R's, the next line of defense is GUILT--RINO GUILT which leads to a McCain-effect 5th column/mutiny. After rino-guilt is fully exhausted then comes BORKING key Republicans. And as this process goes on, they may run back to Oklahoma, Nuevo Mejico, or Looseanna and start the process over and over and over until someone retires from the field. The purpose for all actions is to demoralize the enemy, turn some from their allegience, and strengthen personal resolve.

Let me see: Who has a beter record of winning nasty political battles?

I would have liked to see the judges stay out of the fines and sanctions, too. They're covered by the Senate rules.

I don't like the appearance that the judges are implying that not only may the fines be "moot," but that they'd *better* be moot.

Don't forget that for most of the history of Texas politics, there haven't been enough Republicans to break a quorum or block a blocker bill.

Whitmire quietly flew home during the Labor Day weekend and found his constituents opposed to redistricting but against a continued holdout. He returned to the Senate floor Friday for a news conference to declare that he would be there if a third session is called.

"I intend to fight redistricting on the Senate floor," he said. "I will be present."
