Legal Tragedy for Unemployed Divorced Men & Fathers

I am writing this to make this Legal Tragedy better known and also in hope that someone could help the thousands of us in this tragic situation.

Like many Americans at this time, I have been laid off. This in itself is bad enough for most Americans, but those of us that have been divorced face a Legal Tragedy that is against The Constitution and all moral concepts. Men are almost exclusively affected by what I am about to tell you. This shows the discrimination of the courts and the laws in this country.

Since I have been laid off, I am only “earning” unemployment insurance, which is only 16.6% of my previous gross income. I therefore cannot pay the alimony and child support that the courts ordered in my divorce in Florida. I do not even have enough money for my own expenses. The courts in Florida are looking at finding me in contempt of court because of non-payment. They would therefore put me in jail along with countless others for the same reason. This makes no legal or moral sense in many ways:

1. If I was still married and got laid off, would the courts care, of course not! The family would have to do what they could to survive. But, since I have been divorced, and there is no relationship anymore, I’m supposed to support them over supporting myself, otherwise go to jail. How does this make any logical, moral or legal sense? Why is it that since I am divorced I have a greater financial responsibility than I ever did when I was married? Why should all of my rights be taken away because I am unemployed now, and yet my ex-wife is suppose to maintain the same or better lifestyle as when I was employed? This again, would not be the case if I were still married. This shows that divorce laws take precedence over basic human rights and are stronger laws than marriage itself, which is a bond with God.

2. If I’m in jail, how am I supposed to find a job? After being in jail, it would be very difficult, if not impossible, to ever find a good job again!

3. This type of incarceration was abolished with the 13th Amendment. Which prohibits Involuntary Servitude. Also 8 USCA-56 prohibits Peonage.

Why should my life and other’s be completely destroyed just because we were ever married and now unemployed?

Isn’t the fact that I, and many others have lost our jobs enough of a tragedy in itself? How does completely destroying the rest of our lives solve anything? In this situation, what could any of us ever do to help ourselves?

I was extremely involved in the 2000 Presidential election, supporting George Bush. I lived and worked in Austin, Texas, but I was still a registered voter in Florida. The government and country that I so dearly loved and put so much energy into, has now let me down.

Please Help!

yep thats the worst part of divorce. if you cant be kind to each other and work stuff out the lawyers are the ones that make out like a bandit! so far, just responding to his petty stuff has cost me over 50,000 in 2 years. nuts!
i even tried for a change of jurisdiction and was denied by the fathers "home state". i thought it was federal law since weve lived here for 6 years. before anyone jumps on me for moving, it was agreed...my x even rushed my moving van down the street because he was having a party.

A marriage strike by men until these laws are changed would be quite appropriate.

I doubt it. If men stopped marrying women, Congress would eventually make it mandatory for a man to take a wife. I never considered myself to be 'on strike', but I would have to be bonkers to get married when there are so many women out there giving it up during the 'audition'.

You mentioned about what happened to a relative, what you said he might do is 1 of my options. If my life is destroyed anyways by the courts, why live. :-(

I would become a fugitive before committing suicide. Your ex will go around telling everyone how you were at fault because you were mentally ill all along.

Women who do this kind of stuff to a man should burn in hell.

In my own divorce, I got custody of the kids together with a child support order. My ex called me the evening after the final hearing and told me I would never collect a cent of it-she was right.

A couple can figure out the woman is likely to get custody, the house and whatever is in it

,,, so was I. I was booted out with $NZ35 and my clothes in Dec 1994. That Christmas I was allowed to sit on the kerb outside my home and give my two kids their presents. Time has marched on and the ex lives with my father in my $330k house. She got the Volvos and half the value of investments etc. I was cleaned out big time (because it's for the children). I'm older and wiser now and able to guage the transparency of your comments quite easily. I'd bet in this regard you'll have little to offer any prospective partner on a long term basis with an outlook like yours.

Great article and dead on. I dated like crazy and I made loads of dough. Those cute girls were never a consideration for marriage. They were money hounds waiting to bait me, only to get preggers and use me and the children as trophies, and I knew it. I was to be no trophy husband. I married a great gal. A good friend describes her as "one cool lady." She was professional, going through her Masters, made her own way through life and enjoyed who I was.

One day my best friend an I were at the dirt bike track. His wife was a bitch about him riding. Mine loved it. He asked, "You ever going to marry that girl?" We were engaged two weeks later at Christmas. Seven years later and we're doing great.

My sister, who claimed I was too "irresponsible" to ever marry, is divorcing her husband after 20 years, leaving my nephew, a 17 year old senior in high school . Her complaint, "[My husband] is too boring." She wants to party and get laid. Her hubby is a great guy and never cheated or abused her. He is actually a fun loving guy, she is just a party pooper. He was always the responsible one, and recently retired Air force.

She likes to tell "men suck" stories. AT 39 years old, she is in for one rude awakening.

Here's your chance to shine... tell me what's going to make you a real catch for the sort of woman who wouldn't throw you on the electric fence that this thread is all about.

I'm retired Navy, and I have seen this a thousand times. Retired military persons are seen as automatic check machines. The women know the checks will be coming, and if necessary, her portion removed before he even sees it after she gets the courts on her side.

There are women who cant resist the idea of getting that money without having to put of with the man who earned it.

I've read through most of this thread and have come to the following conclusion You're Mad. Not Fighting mad, just mad. As in off your rocker! Not showing up in court? Bad move. They're not going to throw you in jail for showing up in court. They ARE going to throw you in jail for NOT showing up in court.
