Second arrest made in immigrant incident

Yuma County sheriff's deputies have arrested a second man in connection with the alleged unlawful detention of six illegal immigrants on July 31 in Gadsden.
Alexander David Dumas, 26, was arrested Tuesday evening after driving to Yuma from his home in Big Bear Lake, Calif., for an interview, said sheriff's spokesman Lt. Eben Bratcher.
Dumas was charged with six counts of aggravated assault and five counts of unlawful imprisonment following the early morning July 31 incident where deputies said he and Matthew Paul Hoffman, arrested on the same charges on Monday, detained a group of six illegal immigrants that had just entered the United States through the Colorado River.
A third man, Martin Hoffman Jr., was with the two suspects but won't be charged because he was not armed and did not take part in the handcuffing of the illegal immigrants, Bratcher said.
Bratcher said the department will continue to investigate the case and warned citizens against taking the law into their own hands.
He said anyone who sees a group of suspected illegal immigrants should call the Border Patrol, and not take it upon themselves to apprehend the group by using guns and handcuffs. Asking a group to stay put while making a phone call is permitted and would constitute a citizen's arrest, he said.
"When you have someone holding someone against their will with the use or the threat of the use of force, you've crossed the line between a citizen's arrest and unlawful detention," he said. "There was no justification for the use of force."
Deputies said the two men handcuffed five members of the group, which included three children and two women, and held them at gunpoint until U.S. Border Patrol agents arrived.
Agents have said they were dispatched to the scene when a surveillance camera operator noticed the incident unfolding. The agents called the sheriff's department, who then identified and interviewed all three men before letting them go, officials said.
Bratcher said the men are not believed to be part of a larger group, such as the citizen patrol groups that operate on private property along the Tucson border and use various forms of technology to alert Border Patrol agents to the presence of illegal immigrants in the area.
Also being charged with five counts of endangerment is a 16-year-old Mexican national who Bratcher said was paid $600 to bring the illegal immigrants into the United States. Bratcher also said the illegal immigrants were planning to meet with a taxi cab in Gadsden and were to be taken to a unidentified Yuma hotel, according to interviews done of the illegal immigrants by detectives.
William Robbins, Border Patrol spokesman, said the six illegal immigrants were in the agency's custody as of Wednesday morning but couldn't be interviewed.
Hugo Oliva, Mexican consul in Yuma, said the group was in good condition following the incident and that his office is encouraged by the sheriff's department's efforts regarding this case.
"This is a very disturbing thing to happen here," Oliva said. "We can't have people with guns do the job of law enforcement agencies."

Like the Border Patrol cares or would round up the illegals. Anybody calling in and reporting illegal aliens would probably be charged with racism and a hate crime by the local D.A. Then there would be a civil trial crying suffering and a big award. DoughtyOne has a great list, and I'll take the liberty of reposting it...
Let me see if I've got this right. Citizenship today guarantees...
1. You get to compete with cents an hour overseas employees for your job
2. You can't afford medical coverage, to take vacations or to save for your retirement on what you earn, and your employer doesn't contribute to any of these
3. Your neighborhood has been overrun by third world individuals who make about the same salary you do, only under the table
4. You can't afford to support your own family, but the folks mentioned in item 3 can afford to send billions collectively back to the old country, further decaying economic activity in your neighborhood
5. 50 to 75% of the people in your own home town don't speak English and want to forsake US holidays and celebrate those from the old country
6. Your president fails to notice your income status, but thinks people from other nations need billions of dollars worth of supports
7. While you don't have the funds for medical care, the foreign national gets it for free
8. While you can't afford to send your kid to college, the foreign national get free k-12 education for his children to the tune of $80 to $120 thousand dollars.
9. Your children get a small discount on their college tuition if they are instate, because you worked your whole life paying taxes to support these programs. The foreign national's children get these discounts because, well just because. It doesn't matter if most their parent's income was under the table thus avoiding taxes.
10. While your wife gets strip searched or x-rayed at the airport, revealing the most intimate of her personal anatomy, our borders remain wide open, people from terrorist states STILL entering our nation. Your bank and your state recognize foreign IDs which are not secure and may actually facilitate the monetary transactions of terrorists. While you have to provide secure ID at airports, the illegal alien can now obtain the same ID without secure documentation in a growing number of states in our nation.
11. While your family endures this treatment at our airports, merchandise crossing our borders passes thorugh 95 to 98% uninspected. It receives better treatment than it's human counterparts.
12. While you see fewer movies and go out to eat less often, the government redistributes what funds you to take home, giving it to people who do not pay income taxes at all.
13. If you are married, you pay more taxes than if you and your wife weren't. Fixing this just wouldn't be reasonable.
14. The crowning act? When your governor and the president celebrate the day that American citizens make up less than 50% of your states population.
I don't have to "predict" anything: most of the violent crime in Phoenix is committed by illegal aliens. People here are so sick of it that when a victim does something like drive over a bunch of them in his Hummer (an actual recent case), the whole state applauds.
The 'vigilantes' in the case at hand can't be accused of using disproportionate force. They just held a batch of illegals for the Border Patrol - the same job we hired the Border Patrol to do.
It's likely only a felony because the law enforcement has decided to apply it that way, by derecognizing the right for anyone other than a police officer to detain via display of firearms. There might possibly be some law in the particular state that defines a difference, but not likely. Generally, it's enforced that way because the police don't like citizens doing what they do, not because there's any law differentiating between the acts.
In short, it's not a felony because of the act. It's a felony because the particular police don't like it and choose to mangle the law with judicial consent.
Well, just today the California SC decided to let the recall proceed.
I'll bet my bottom dollar they poured over that Constitution to find a way to save Davis.
Bustamante is widely despised in California. I'm quite pleased that he did what he did today.... because his buzzard flag-waving traitor behind will go down in flames, guaranteed. In short order.
Not by much... it's a wide spot in the road. If they went to the river with the intent to catch invaders I suspect thay could be no more than a mile or so from the border.... if that.
