In the scenario of your #1 and #2, Cruz couldn't keep the job unless he was the winner of ballot #2 question, right? And if he wasn't, what's the law say then -- new governor appoints a new lt. gov? Because Cruz would have resigned. Or would Cruz appoint a new lt. gov at that time?

As I understand the law, if Davis resigns and Bustamante takes over 'til Oct. 7, he has the right to fill the Lt. Gov. spot ... but yes, Bustamante himself will not be able to go BACK to that lower office after the recall vote. And whomever he picks to fill the Lt. Gov. spot will serve out the rest of the term, through the end of '06!
