why then would not 51 votes put Astrada on the bench?
Because the Senate Rules do not provide for time limits on debate... The call to vote must be agreed to by all or it doesn't occur. If it ever occurs on the Up or Down on Estrada he'll win with the 55 that has said they've vote for his confirmation. It's getting to that vote that is the problem.
To shut down the debate cloture is a possibility. That requires 60 votes by the Senators to start the process of bringing it to a vote under the cloture rule.

Strategy is that the Senators have respect for Senate, don't want to change rules.
I don't think Rush sounds like he particularly likes the explanation he is giving for this.

I don't think it was the same advise and consent. One is for placing someone on the court, and the other is for making someone Chief Justice. Make an Associate Justice a Chief Justice, to me, isn't even the same elevation as making a Circuit Court Judge a Supreme Court Judge.
In Fortas' case, he was already on the bench, and his voice would be heard no matter what. With Estrada, his placement on the bench changes the makeup of the bench. That's why this filibuster is a direct attack on the president's ability to place judges, while the Fortas filibuster wasn't an attack on the president's ability to place judges.

Article II, Section 2, Paragraph 2 of U.S. Constitution (in part): "... and he [the President] shall nominate, and by and with the Advice and Consent of the Senate, shall appoint Ambassadors, other public Ministers and Consuls, Judges of the supreme Court, and all other Officers of the United States, whose Appointments are not herein otherwise provided for, and which shall be established by Law..."
I make that only one advice and consent for all federal judges.

I emailed our senator Max Baucus (D-MT) this weekend and I received an email back stating that he is firmly going to vote no against Estrada. Dork.

I don't understand the question completely.... but if you mean if Cloture is agreed to then at the final end of the cloture process it's an up or down vote. The answer is yes. But there are at least 30 more hours of debate possible under cloture plus other restrictions on amendments, limits on senator's debate time, etc.

Reading here I see that the Dems will use their time to bash the President in an effort to get the Republicans to shut them up. Has anybody spoken about the questions that Estrada was made available to answer?

Did you all hear Rush this afternoon. He was on the radio when I was coming back from Tinker talking about the article he relied on last Friday as being less than accurate on the Estrada nomination.
Finally he got it that a cloture vote does not kill the nominations and the more you put the RATs on record of oppossing Estrada the better it is. Right now they don't want to force a cloture vote but they will sooner or later and keep doing it until the RATs cave.
In fact, Rush said the Republicans are sure they have 55 votes and could have more!
Wouldn't you know, I get back and Leahy is on! UGH!

correctly. I think it came out that he received money from left wing org. while srving as Associate Justice. It forced him to resign. I think Rehnquist was nominated to his seat when Nixon won the 68 election. Johnson had app. a Justice

Let's hope the advisers are right and Iraq war only takes a few weeks.(trying to set up the highest possible bar for our soldiers to jump over). Talking about his soldier Son.

Wants to give the UN inspectors more time.
He's a Chicken Little and I am sure that President Bush has considered each of these issues in far greater detail than Leaky.
