I knew it was in the works but hit the Wash Post today! Believe that is why the RATs are discussing filibuster in committee now as well as on the floor.

Just thought the timing of the announcement was hilarious.

Rather silly. IF the memos were intended to act as the devil's advocate, they would be so labelled if Estrada had any smarts. One would simply start by saying that the arguments for such and such a position that are likely to be taken are so and so, as opposed to advocating what a correct judicial opinion would be, or should be. In any event, if that was the intent, Estrada could deflect them, and name who asked him to take one side of the argument to anticipate the opposition's arguments.

PKM, I still agree with your overarching theme that the opposition to Estrada is being pushed by Hillary and is personal. As to the specific reasons, who can know. One thing as food for thought, though...

Over the past many months very quietly and under the radar there have been several plea bargins between the Feds and former Clinton cohorts. They have been posted here but have had little play.

Add to that, Clinton's "All about me" tour the last few weeks.

It is almost as though Clinton is expecting more bad news and is out Bush bashing so he can say the only reason they are coming after him is because he has been critical of Bush.

Nevertheless, something is up here. This isn't just about abortion and non answers to questions that should never have been asked.

Seriously, this is a time for Bush to say ... "Eff it. Pry Orrin off the floor Senator Frist, put up the white flag, send the Senators to their cyrogenic chambers and let's get the Bench openings filled so we can attack this 5 YEAR backlog on the DC, third and fourth Districts. Get me a recess, I'll do the rest."

The DOD needs money to send four carrier groups and 150,000 soldiers to Allahland. The Department of Homeland Security needs a budget and some cash in the bank. The guys at the airport look hungry and pissed. The Ag department needs money to buy and send all the foodstuffs to SaddamWorld. The Treasury department needs to cut Purchase Orders for equipment and needs moolah for payroll. They need to pay INS, FBI and Customs personnel. We need oil, we need paper, we need ordinance, we need IT upgrades ... and our vendors need to be paid.

We need Senators to do their fooking jobs.

Not engage in "Let them Eat Cake" parlor patter. This dismal Kabuki drama is an unaffodable luxury right now.

And ... Secretary Rumsfeld and Joint Chief Chairman Meyers testified before the Senate Armed Forces Committee this morning. The Senators came and went like it was the reauthorization of funding for the Helium reserve to guarantee operation for our Military Dirigible fleet.

We are going to War. Two men who have profound influence and destiny in this endeavor were sitting before our Legislative Branch. Nobody thought it important enough to listen to the questions and answers of any other Senator on the committee. They were getting political instructions for the upcoming Estrada filibuster battle on the floor. That was the political priority ... THAT'S HOW THE DEMS STILL CONTROL THE SENATE!

So ... if Diane Feinstein missed something in Rummy or General Meyer's presentation of issues involoving life and death, well so did Kennedy and Levin, so they'll just put an institutional hold on the whole DOD funding mess until their staff fills them in tells them what the politicallly advantageous thing is to do.

This Estrada thing is a morass, and it can be solved with one recess appointment and resultant scumbag Marxist mewling, whining and operatic injury. Bush needs to groin kick these hooligans into shape.

Captain Cook threw the malcontented grousers overboard when he was navigating the reef. Not that he was perfect, cuz who wouldn't die for a Polynesian woman?

Let's get the train a rolling.

Don't think Bush will do a recess appointment and I'm not sure this is one of those periods which is a true recess; i.e., the break in between sessions.

Anytime the Senate body shuts down operations, they call a recess of business. It ensures that all rules of quorum, procedure and legislative process are frozen. They will be in recess next week. They are in recess A LOT if you check the planner. Overpaid roosters.

Now, if Bush signals he's hip on a recess appointment, the Dems can stuff that. I hope the Dems are arrogantly counting on the gelding status of their GOP counterparts, and believe that Bush wouldn't risk a contentious Executive Judicial appointment in an environment of impending War and the "bipartisan" necessity that circumstance warrants. We need the people insidiously opposing this War on Y2K Hitler on our side ya know!

As a source "close to the Administration"*, I advise Bush to send ALL his wonderfully qualified "orphans" to the Federal Bench in a flurry of activity and extravaganza that says ...."eat me".

Oh, how Daschele will weep with "disappointment" and Robert Byrd could pass away live on C-SPAN.

As much as I admire your well thought out analysis
on the issues, I just can't agree with you on recess
appointments. I know this filibuster fight is a harbinger of things to come. I do not think you can cure the underlying problem, with a cure the founders created for a completely different reason. After all it took wks just to get from NY to DC and the Senate and the House only met
for one session. The Democrats will pounce! They will say
they coudn't get him through with a majority and now look at what they are doing. A non-truth yes, but with an enabling press and their spin machine in full gear, well
you know the rest. Remember the lie is their best friend,
they are "clintonized" I say give them nothing!! they
know they are holding the short end of the rope, and
are already in disarray.If we win this key battle all
options in our conservative agenda are in play.

You'd ask Estrada to give up a life-time appointment and/or a fast-track to the Supreme Court and you'd deny the President the right to have his nominees benefit from a straight up or down vote just to gig a democrat ? Sheesh. I loathe democrats as much as anyone but that is just foolish, IMHO. Moreover, it is unfair to Mr Estrada and to the President. If you're all that disturbed then stop complaining and do something positive to move this along. There is no reason to leap to conclusions on this at this point. The White House is gonna win this one and Estrada is going to the DC Court of Appeals.

I saw the dynamic of Orren's righteous meltdown last night.

First, he opened his vitals by overplaying the Hispanic trait of Mssr. Estrada. The Dems were going to respond in a race-baiting way that is eons more advanced than a good, virtuous man like Hatch could handle.

They found Orren's wound ... that Judge Paez (sp). They used the slowness and hurdles of his confirmation process, while Hatch was running the Judiciary, as a bludgeon to say "Hey, you stiffed THIS Hispanic guy."

Hatch went to the wall for Paez, he got him voted by the body and confirmed to the "never wrong or socialist" 9th Circuit court over the objections of many GOP colleagues who understood what an activist, dullard and lefty hack the guy was. Hatch played fair, as a gentleman and statesman then. CHUMP! The Dems stuck it up his backside last night, lying about his actions in that process, impugning his honor and intent, and showing contempt for the personal political capital he used within his caucus to get the guy a fair hearing, vote and eventual confirmation.

To use that against him ... that was a profound betrayal to Hatch. Well ... Orren ... welcome to the world of insects, hyenas, crocodilians and Democrat partisans pal. No good deed goes unpunished with these RAT vipers. His outrage, betrayal and contempt for the soulless deceit of Durbin was palateable ... but Durbin didn't give a crap. Mission accomplished, time to get servicing by cult-driven libreal girl or boy or both.

That's the way these scumbags operate. The GOP Senate is playing fair right now - but the outcome is fated to mirror that of the frat pledge from the movie "Animal House" when he viewed the carnage of what used to be his dad's Cadillac after the road trip ... Matheson said ... "Hey, you f***ed up, you trusted us." There's a snake parable that comes to mind too "you knew I was a snake."

Hatch was genuinely betrayed by that RAT foray. Mission accomplished for Durbin.

Enough of this stuff. The American left, the Democrat pols are the enemy of America, just like Hussein, Bin Laden, European communists and the House of Saud.

Savage has it right, it's a two front war. Bad guys bent on America's destruction abroad, and bad guys bent on America's destruction at home.

The votes aren't there! Nobody's mind is changing. They're ensconsed. There's no 60 vote outcome. NEVAH!!! EVAH!!!

The Democrats have hijacked the Senate with this filibuster. They're preening for the swamp dwellers who need some victories over Bush and America.

There's no upside here. There's no win. Take a step back, give the shoulder fake, get them leaning and then rip the right cross on your opponent. It's chess, you go forward and backward, and it's all positive.

I didn't expect the Democrats to flaunt the integrity of the institution so soullessly. OK ... none of us did ... but they have, and they will, and they can.

Time to step back and deliver a new KO punch. They don't think Bush has the guts to look "Partisan" at war's brink. That's their calculus, Nopardons, I'm convinced.

So, feign surrender on this consent process, let the RATS go to their flower throwing nutjobs and Commie sponsors, and Bush should place 10-12 nominees onto District Benches through Executive Appointment.

There's NOTHING to gain by indulging in a pose down with THIS Democrat party at THIS time in our history. Smoke them mercilessly, make them pay for their hubris. They're the enemy.
