There is no murder 1 or murder 2 in Texas. It was either murder or not. The equivalent to second degree murder under Texas law comes in the penalty phase of the trial.
In Texas, if you intend to kill someone, even if it is a nanosecond before the act, it's premeditated. Murder.
She intended it at the moment, and the victory laps over his body are damning evidence of that.
