California's War on the Civil Rights Initiative

"The state shall not discriminate against, or grant preferential treatment to, any individual or group on the basis of race, sex, color, ethnicity or national origin in the operation of public employment, public education or public contracting."

This tribute to fairness and equality is now a part of the state Constitution. It was approved in 1996 by the voters of California, who wanted to end affirmative action, quotas, set-asides and other preference programs. The refusal of some state and local government officials to honor this mandate is now blocking implementation of the California Civil Rights Initiative, commonly known as Proposition 209. Why?

In his oath of office, California Attorney General Bill Lockyer swore to uphold and defend the Constitution and laws of California, yet the state's chief law-enforcement officer refuses to enforce Proposition 209. Indeed, the attorney general has even stood before the California Supreme Court to demand that the constitutional amendment be interpreted in such a way to water down its protections against granting preferences based on race or sex!

Why aren't individuals and groups adversely affected by the non-application of this statute filing lawsuits?

Lawsuits are still pending in the courts. This state's affirmative action culture wasn't started in a day and it won't end over night but sooner or later every one will comply with the law. All necessary changes take time to be accomplished.

This is yet more evidence that the Left has no genuine grasp of law or logic. Consistently, the Left has demonstrated that it has no respect for law and order, that it will gladly trample both for the sake of its interests. The Left does not believe any laws -- including the fundamental Constitution itself -- are really binding, and treats all laws as suggestions, to be disregarded ad libido.

As for logic, the Left demonstrates once more its sadly twisted and thrawn understanding of discrimination: For the Left, discrimination is always acceptable in favour of "the downtrodden" (except, of course, for Roman Catholics). The concept that discriminatory measures opposed to the Caucasian Anglo-Saxon majority is actually self-perpetuating is completely beyond the Left's intellectual grasp.

For the Left, something is never unlawful, or unacceptable. Something is only unlawful or unacceptable insofar as the Left does not like it.

Amazingly, if the Left were genuinely concerned about putting an end to discrimination, why does it have such difficulty with so starkly an anti-discriminatory measure as this?

All of the rat elite fascists in power in Kalifornicator have been blocking the implementation of Prop 209 since the day it was passed.

Remember Al Goron's chilling words re how criminal rats in power look at the law: There is no controlling Legal Authority!

This is why the Rats in the Senate opposed approving any of GW's federal judicial appointments. They do not want real judges on the bench. They want their maggot infested ACLUers on the bench to interpert law for the Rats and to block laws like Prop 209!

The Left seems to think such a thing will boster their chances - unfortunately, it will cut both ways.

The folks in the middle - non-ideological, independents, that sort of people, don't follow politics all that much - do not like people who try to hold on at any cost. This is why the Dems will be wiped out if Al Gore wins the 2004 nomination. Too much of a bad taste in people's mouths from the Florida fiasco.

To back up what you say about the middle. Prop 209 won big time 6 years ago. This was after the state went big time in 92 for the Clintoons.

So a lot of people in the middle wanted a change and to get rid of the phoney affirmative rights and to have real affirmative rights for all of us. So they joined the conservatives to vote for Prop 209.

The arrogant criminal elites in charge of the Kali Rat party immediately went to work with left wing judges and legions of ACLU maggots to block implementation of what the people of Kali wanted. That was true color and sex blindness in Kali, not the phoney Affirmative Action programs of the left.

Very similar thing happened here in Oregon. We passed prop 7, which mandates paying people just compensation when re-zoning their land. Oregon is obsessed with "zoning and planning" and has a supra-county level of government that sets "regional growth boundaries" and basically trys to control everything with zoning laws.

The measure was immediately appealed. The appeal was made by a liberal advocacy group, the "1000 friends of Oregon" The bill was "defenced" by Democratic Governor using the Democratic Attorney General. The defense apparently included pre-trial discussions between all three parties where it was decided on what basis the law would be found unconstitional. (BTW: it was the "porn shop exception" that did it in. This said you could not be compensated if you were not allowed to open a porn shop due to zoning).

This was an amazingly blatent over ruling of the people by the Dem elite, but we just elected another Dem governor, so it will continue.

What happens historically when peoples legitimate political expressions and decisions are thwarted time and time again by powerful elites?

This would be a good time to get Prop 7 turned down by the 9th Circus of Clowns phoney court. Prop 7 would be upheld in the Supreme Court like 269.

Prop 7 was/is an impediment to the Watermelon Green Jihadists in Oregon who want to rurally cleanse all vile humans who dare to own property in Oregon.

Either by voter fraud or by terminal stupidity, your fellow Oregonians have elected another tax and spend Rat who is in the pockets of the Green Jihadists who really control Oregon.

What's going to be interesting is what happens when Ward Connerly's new Racial Privacy Initiative hits the ballot in 2004. If that passes, they'll also have to ignore its prohibition on gathering racial data, or simply ignoring 209 isn't going to be enough. The presence of that initiative on the 2004 ballot (plus the ongoing fiscal train wreck that is the California economy) is going to bring out a lot of people who will be also voting for Republicans, in my opinion. We might finally start to get this state back. At least that's my hope.
