No sorry, he was with another person who kept talking over him, and didn't say that much. He just squeezed this in before the break. But he will probably mention it sometime if we keep an ear out.

Who pays for this could be a huge issue, because the Greens and Libertarians are ornery enough to visit this issue again.

Assume that the Rats win this one, and that the State pays for the recount. In the next election, I wouldn't be surprised to see those disruptive little Greens try to replace their candidate exactly 35 days before the general election. Just the type of granstanding ploy they might pull, and it would be hilarious. As the Rat lawyer said, the reason for the withdrawal is irrelevant....

The only way you can avoid this is 1) to require the Dems to pay for it themselves, which plays right into the Greens argument that this is unfair to minor parties with limited resources, or 2) change the law after the election to make the deadline hard and fast, so that nobody can do this again. Either alternative makes the Court -- and the Dems -- look bad.

Anyone who is supporting the Green party candidate is doing so out of a strong belief system. If the Green party, for example, put in Forrester, their supporters would be furious and would not vote at all.

The point of the commercial message would not be to promote ANY of the candidates but to paint the democrats as fundamentally dishonest.

How would this be a National Party thing rather than Local? These elections have a tendancy to have effect at the State level rather than the National.

If I were a NJ Republican I would be outraged if the party didn't use all means available to stop this attempted seat theft. You have to hold your core and build.

THe wise decision here would be for the NJSC to simply state that the deadline has passed for Torricelli to withdraw his name off the ballot...However, Mr. Loutenburg can run as a democrat WRITE-IN and thus you do not disenfranchise any voter...any other answer disenfranchises all MILITARY personnel as well as the mail in voters!

Exactly. What really is the meaning of April 15th? October 21 is a fine date. Thanks to Jersey judges I can explain the capriciousness of dates in law books to my IRS auditor.

Wonderful point. Not all absentee voters would be disenfranchised, but many -- perhaps most -- will be.

But, hey, we're talking about creating legislation to keep Dems in power!

What was the federal issue in Bush v. Gore and why is it not present here? Wasn't it "equal protection" being violated when new rules are made up on the spot to benefit one candidate. Isn't that identical to what is happening here.

This is a fight to submission, we need to take it to the Supremes and get our 5/4 victory.

No, the equal protection issue was the votes of voters from different counties being treated differently.

Yes it was cited in the GOP argument- it is Bush vs. Some Florida County, not Bush v. Gore.

Aren't the Dims playing this rather dumb? Why couldn't they just leave Torch on the ballot and have the governor announce that if Torch wins and refuses the seat he will appoint someone else until the next election? Sort of like the Carnahan scenario. They have almost no chance to win this thing even if they get a replacement name on the ballot.

I live in North Florida. Don't EVER compare us to New Jersey. Change your name to South Florida. Or South Florida can change its name to South Jersey. I won't protest if they suceed from us...but then they would vote in McBride and we would have 2 communist states to the south of Jacksonville.
