Judge Rules in Favor of Katherine Harris
Leon County Clerk of Court | 9-11-02 | Me

Posted on 09/11/2002 8:08:26 PM PDT by KatherineHarris4Congress

I've just been scanning around again re-reading the court case of Jim Hill v. Katherine Harris, and noted the new addition as of 9-11-02 "Final Judgment Summary". Here is what the judge stated:

"Based upon the disputed facts and applying well established legal precedent, this Court finds that Harris did not comply with the mandatory, resignation requirement of F.S. 99.012. However, her non-compliance was statutorily forgiven by operation of F.S. 99.012 (4)(f). She has qualified for the primary election and shall not be removed as a candidate for the election to the 13th Congressional Seat."

He went on to say how he ruled against Hill in other issues. To read the entire summary judgment, visit the Leon County Clerk of Court website.

Thanks be to God.....this really had me worried even thought I felt there was no legal basis for the suit! Afterall this was a liberal judge who had recently ruled against school vouchers!

Some good news at last!

Why did you select political humor/cartoons as a topic?

Great news!

Anyone know the gist of the statute that "forgives" her, as the judge stated?

Basically, it says that if no letter is submitted upon qualification for office, the irrevocable resignation is deemed effective upon filing. The remedy is included within the law ("forgiveness")- and the part about a judge removing the name from the ballot is reserved for cases of fraud.
This has been a red herring from day one- and the goofy judge's refusal to rule before the primary was just a feeble attempt to cast doubt on Katherine.
The voters didn't buy it- record turnouts, overwhelming victory for Katherine.
YES!

Thanks for the ping. Amidst all the other election fun in Florida, I'd missed this. It seems you got things right.

To katherineisgreat: If you don't get a job as one of her staffers, I'm going to very annoyed.

I have no idea, sorry about that. I was half-asleep when I was typing all that, and just clicked the wrong one. Ha..that's what you get for being a college student, lack of sleep!

I'm a sophomore in college, and in May, I had an interview with Katherine in Tallahassee for over thirty minutes, and one of the main issues during my interview was about internships. So, we talked about the possibility, and she gave me one of her other e-mail addresses, to e-mail her back and forth after I talked with my advisor about some things she wanted me to ask! So,while katherineisgreat is in high school, I'm in college, and I've met her and hopefully, as long as she wins in November, I'll have an internship for either the Summer of 2003 or 2004, or both!

Great news catch! Your resourcefulness will be a great asset as an intern for Katherine (that's how certain I am of your success in getting the position) :o)

Roop doop doop!

I went to the Leon county clerk of court website and found the document. It's in PDF format, which requires Acrobat Reader to be installed:

Also, a summary list of all docs regarding this case can be found here:
