The jury instructions are (paraphrase): when confronting circumstantial evidence if there is one or more reasonable interpretation which leads to guilt or one or more which leads to not guilty you MUST (*NOT* may, might, can, or could) accept the interpretation which finds the defendant NOT GUILTY. MUST. The defense offered REASONABLE doubt well within what was "needed" here where the burden of proof rests entirely on the prosecution.
The prosecution said: here's a few specs (improperly photographed & never typed to see if it was blood) which contain van dam DNA, oh and here's a fibre that could maybe be from carpet that DVD encountered (but never mind that Ninja Dave was visited twice by three members of the VD household which could REASONABLY explain cross contamination) and there's a fingerprint (so she was in the motorhome but our trained dogs never alerted on the motorhome because they're obviously useless, right?). Here's our expert on bugs (but wait, don't listen to him when he reveals another hole in this charade we're putting on to stir your pre-disposition to convict "child killers" and "child rapists"--afterall we're only putting him on as a scientific expert when it helps, this is junk science if it helps Ninja Dave).
Explain to me again how we "case not proved" Freepers can't think straight?

Not sure they're all really Freepers. Ah yes, the "pro adult-child sex" constituency. Guess NAMBLA's web site is under construction or the plug got pulled by their ISP or something.

I stick by what I said, the ones on this thread that were flamed are not posting now, and Kim did not leave even when she was flamed and outnumbered. I (we) give her support for that...

They why didn't Westerfield get on the stand and provide testimony to that effect? If that's all it would take to convince you he was innocent why didn't he do it for this jury? I'm not in the least convinced that he's innocent. I just want to make certain that there'e logical evidence to convict him. I do not see it.

"Another OJ" may have been in the back of the minds of these jurors. They didn't want that sort of reputation. Really enhances the need to get cameras out of the courtroom.

Recognized as a blunder. :o)

She went upstairs to the defendant's head of his bed and placed her fingerprints there? The fingerprint was in the motorhome.
To: marajade
Good Lord, marajade. There were no Danielle fingerprints upstairs by his bed. Do you watch Court TV? The only fingerprint was found on the side of a cabinet in the motorhome, also the only location where the single hair was found. Did you also know that there was only one single hair of Danielle's found? Court TV would have you believe they were all over David Westerfield's bedroom. Blonde hairs upstairs in the sheets, on the pillow, in the bed. Yeah, true. But when they were examined by the forensics lab, NONE of them matched Danielle. Not a single one. (Only Court TV didn't tell you that part, did they? See why it always helds to watch/read the actual testimony?) Baaaaaaaaaaah.

I guess I misunderstimated the dumbing down of America. LOL!! Likewise. When I went to school the people who edited dictionaries were the gatekeepers of proper English. Now they are the prostitutes of vulgar language.

"I do a lot of appellate work. The odds of this getting overturned on appeal are about the same as my odds of winning the lottery this week. And I'm not going to buy a ticket. "
Maybe it's just the shock of the veridct..I hope you are right.
Thanks..

"The fingerprint was in the motorhome."
Then that's enough for me... Thanks...

Hi,
She *was* in the house when they sold the GS cookies! And Brenda wanted him to show her the kitchen remodel. While I wouldn't let my kids run amuck through someone else's house, who's to say that 7 y.o. Danielle didn't (Brenda was - uh - occupied with a guy she was going to "dirty dance" with later)?

I am most definately a FReeper and question the guilty verdict. I've been a FReeper long than you have too. :o)

If this creature is put into the General Population section of prison, how can we be guaranteed that he will, a.) be put down
b.) be put down quickly
c.) be put down in a very sadistic and painful way, the way the little angel died?
feedback requested...

Not because of the evidence but i cannot see 12 people agreeing on a not guilty verdict. My bet its guilty. I'm may have missed something--the only thing that you would need an agreement of the 12 would be a "Guilty" verdict, right?
