Kopel strikes again. Wouldn't this be nice. But the government give up power? Never! Gun Control Laws are not so bad in places like Utah. But if you're like me, living in the Peoples Republic of New Jersey, they stink.

Suppose that a state wants to outlaw so-called "junk guns" (inexpensive handguns used by poor people for self-defense). The prohibitionists make sanctimonious claims about merely wanting guns to be safe and reliable.

Suppose the government only allowed special made gold-plated guns that only the government and Bill Gates could afford?

Although the 2nd ammendment has been abused by those who would like it to mean to opposite of what it clearly states, there is a part of the constitution which needs to be updated first. That is the interstate commerce clause:

To regulate commerce with foreign nations, and among the several states, and with the Indian tribes;

I think this should be changed to allow the federal government to regulate trade with foreign nations and Indian tribes (although the second really doesn't matter). They should also have the power to declare void any law the states enact regulating interstate trade.

They would then have the power to prevent the states from restricting interstate trade, but wouldn't have any additional power to regulate it or anything peripherally touch it. Probably half of the federal government would be made illegal though that change.

11th. Amendment: Congress shall make no law abridging the individual rights as enumerated in the 1st. through 10th. amendments. Nor shall congress permit any state to abridge these same individual rights. Congress shall appropriate and expend necessary funds to enforce this amendment.

Regarding the language of the Constitution, this time we mean it. Any Justice of the Supreme Court, any Senator or Representative, any President or Vice President who does not choose to follow the words of the Constitution as written, is welcome to resign from office.

This is a great article. I had never heard of the "Goose and Gander" Approach.
I was thinking about an amendment based on Property. If it's on the market and I have the money, I can buy and keep it.

Any duly elected or appointed government official who breaks his oath of office by not upholding the supreme law of the land as stated in the U.S. Constitution shall be hanged by the neck until dead.
