Sounds like the DA can't make a decision either. Maybe she should go to work issuing visa's to foreigners who want to come here and take pictures of landmarks.

"We must remain a civilized society," Chavez said ..Exactly. If the criminal had still been in jail for the crimes he'd committed, he would not have been breaking into the man's car in the first place.

According to the
NYPost:
July 20, 2002 -- A fed-up Bronx man who blew away a crackhead thief who was rifling through his car was sentenced yesterday to
nine years in prison.

Exactly. If the criminal had still been in jail for the crimes he'd committed, he would not have been breaking into the man's car in the first place. Agreed. The Seattle area is reportedly one of the worst for car theft. Given that it takes something like 9 (5?) convictions before any time is served, I'm not surprised. All they're doing is encouraging the crime.

We need street justice against judges and lawyers, those are the REAL career criminals.

was sentenced yesterday to nine years in prison. Hm. A bit of sensational difference between "three to nine" and "nine." (Does "three to nine" mean he serves at least three in prison and may be freed any time thereafter, or that he serves the remainder supervised on parole?)

He fatally shot Bethea, who had been arrested more than 50 times since 1976Talk about a miscarriage of justice. The judge, and prosecutor should have recused themselves...

"We must remain a civilized society," Chavez said Civilized societies punish criminals, not citizens protecting their own property from thieves..
To: sarcasm
"I cannot send out the message to the community that this is acceptable behavior" This judge seems to have no problem sending out the message that stealing others property is a safe occupation, and that recidivist criminals like this "victim" don't belong in jail until they are too old and feeble to pose a threat.
If there has ever been a better case for jury nullification, I've not seen it. They should have given this guy the "Saving taxpayer dollars and eliminating from society someone we who really should have been locked up in the first place" medal.

Give the judge 3-9 and give Vince a medal. The judge was probably a Democrat appointee and belongs with the criminals they support and turn loose on society.

Given that it takes something like 9 (5?) convictions before any time is served, I'm not surprised. Well, of course it takes that many. After all, we have to reserve space in prisons for those who are much more dangerous than thieves - drug users.

Now the criminals are safe to go about their business again. We have to keep the streets safe for them ya know.

Bronx Supreme Court Justice Martin Marcus sentenced Vicenty to three to nine years behind bars. On July 1, Vicenty was found guilty of second-degree manslaughter in the death of 41-year-old Kevin Bethea.
Google search for Justice Martin Marcus
Governor George E. Pataki today announced that Judges Michael A. Corriero, Joseph Fisch, Martin Marcus, Charles J. Tejada, William A. Wetzel, S. Michael Nadel, Caesar D. Cirigliano, Dora L. Irizarry, Richard M. Klein, Mario J. Rossetti, Edward A. Sheridan, Lawrence J. Tonetti, and Rena K. Uviller were nominated for reappointment to the Court of Claims.
Based on their intellect, judgment, temperament, character and experience, the New York State Judicial Screening Committee found each of these judges highly qualified to continue serving on the Court of Claims. The appointments are subject to Senate confirmation.

It's a virtual certainty that Bethea was a drug user.

It's the Bronx........only cop killers go free.......people who rid the world of human scum get punished.

Usually, crooks that show remorse get the light sentences. Vincenty had it in spades and he still gets locked up for 3-9. He might have had better luck in Texas, where you can use a weapon to protect your life and property. Correct me, someone, if I'm wrong...

I know this is going to upset some people, but really, New York sucks. They keep electing the biggest idiots in the world: Pitaki, Hillary, Al Demato. They have total victim disarmament. They love socialism and have given us FDR who socialized a formerly more free nation. They worship toy celebrity, are the home to the horrible Dan Rathers and Peter Jennings of the world. They go ballistic when an out of towner tells the simple truth as he sees it on the A Train (John Rocker). The adore flim flam artists of every type from Al Sharpton to Donald Trump to Bill Clinton. Other states or cities occassionally yeild up an idiot, NY, like the Yankees, sends up world class ones season after season. There really IS something wrong with the place.
I'd love to be proved wrong and see this judge driven by office by an irate citizenry, but it won't happen. Not in NY.
