David A. Westerfield, 50, is charged with kidnapping and killing 7-year-old Danielle van Dam. He is also charged with misdemeanor possession of child pornography. Prosecutors have said the 80 or so images of child pornography taken from Westerfield's home indicate sexual interest in children.Defense attorneys are trying to show that the defendant is not responsible for the pornographic images -- including those of young children -- found on his computer equipment.
David A. Westerfield, a 50-year-old self-employed design engineer, is on trial for the kidnapping and murder of 7-year-old Danielle van Dam.
Lawson told jurors that he examined copies of hard drives, zip disks and compact disks made by police and took numerous screen captures -- essentially photographs of what came up on the computer monitor at a given time.
Defense attorney Steven Feldman asked Lawson if there was a theme to the animations.
"A considerable number of the screen prints showed bondage -- where women were tied in ropes," Lawson said.
A screen print of an e-mail to a DNWesthotmail.com, as quoted by Lawson, said: "Thanks for joining anime.com."
Lawson also confirmed screen prints the defense entered into evidence last week, that a computer in the office of Westerfield's house was used to access pornography on Feb. 4 at 4:47 p.m., when the defendant was busy with detectives.
Feldman mentioned last week's suggestion that the clock on the computer may have been doctored.
"Did you see any evidence that that happened on any of the computers you examined?" Feldman asked.
"No, I did not," Lawson answered. He said there's usually signs when a clock has been tampered with, such as files being accessed before they were created. Nothing like that was apparent on Westerfield's computers, he said.
Tuesday, San Diego police Detective Johnny Keene testified that he collected Westerfield from his Sabre Springs home that Monday around 3:40 p.m. and took him to the Northeastern substation in Rancho Penasquitos. The defendant remained there until approximately 11:30 p.m.
"It is her," said a detective close to the investigation. "It's female, a young girl, the same size as Danielle. The clothing looks like hers, and the body appears to have been out there three to four weeks, which is how long she's been missing."
I suppose media hype can be discounted, but this statement is just weird.

I hope part of DW's costly defense includes a gumshoe or two checking out the membership of CB.
You are absolutely correct. The plastic sheet theory can/could address "why" there wasn't more blood in the MH. Where could the sheet be? Maybe with her missing pajamas? I think we're all assuming that the MH is where she died. (cept for those who think she died in the VD masterbedroom which is just another theory)I could say that DW really was drunk and "he's" the one who fell on top of her and passed out.... I see a lot of speculating or trying to fill in the blanks with educated guesses. Is there a problem doing it? I don't think so...I know some lurkers got annoyed hearing the wilder theories..
On a hunch..they decided to research the area....the stench of the body was strong, per Chris and Karsten.....poplulated dump site...trash all around her...she could be seen from a distance.(Karsten)....yet no one dumps ANY trash there for 27 days....and why wouldn't this dump site be one of the first places one would search?
Why haven't we heard more about the blue blanket that the searches were told to look for?...are these the same blue fibers found on her body??
Feldman's questioning of Chris leads me to believe he will be recalled.
"I wish just two things in this case "fit." Sure is hard for a novice sleuth like me to make heads or tails of anything presented so far...))--BarlF"
I think that it could be explained easily. He used his MH on a regular basis..so to see him drive all over the pace, would not be unusual and if guilty he wants to change his routine as little as possible. (note:it's a bedroom on wheels) There are many people who don't see that it could be unusual. Do you recall the serial killer who was also a beyond local truck driver? I remember seeing something about it on tv not that long ago. He kept his victims handcuffed to the bed in the cab of his semi with a gag in their mouths. (I think he even took pictures of his victim, but don't quote me on that part) Drove all over the country torturing and then killing his victims. One victim got away..the cops pulled him over, took her to see him, and she was too frightened of him to even identify him..
He was all used up by the LE lead..got squeezed dry..
It was not found in the MH...nor the vacuum cleaner bag from the MH...nor the shower drain from showering off the remains of the rape...the dogs did not hit on the MH on 2/4 or 2/6.
That little girl was not in that MH on that weekend.
I considered that too...but thought what the hey..the trial will be over soon..
In her testimony, Jennifer Shen said she was sifting through the debris found at the recovery site to see if there were any similarities between what she saw and what she had already examined from DAW's house. Defense asked if she compared any of the fibers on Danielle to materials from the VD house, and she replied that she did not receive any materials from the VD house to examine.
Yet another one to add to the Hmmmm list.
