Davis, I understand, announced the other day that Lockyer will appeal the Ninth Circuit's decision. Does he have any standing to appeal that decision when his government, as the Ninth Circuit's decision attests, took no stand in the Ninth Circuit's initial decision? Haven't he and his government already defaulted in the case, by that failure?

Are there civil penalties for ignoring a call for appearance at court...if you, me or joe citizen did this we would be in jail double quick.<p.
Also can't there be a filing of mandamus (sp) to force him to appear and do his job in this case?

I doubt that we'll see this in any of the California lamestream media, and even if they did cover it, he'll just deny that he knew about it, that it was handled at a lower staff level, blah, blah, blah.

Right. About all I've seen so far are Davis attack ads on Bill Simon's business acumen (or lack thereof), and the media shrieking about how all California's problems are because of greedy Enron executives.

Considering the prevailing culture of victimology in California, I think Simon's chances are long indeed. That, and the fact that like most Republicans, he doesn't seen to have a clue about bare-knuckled alley fighting, unlike the Libs.

Service of Summons by Certified Mail alone is NOT good service within the State of California. CCPs415.50
This would have required personal service on the "the clerk, secretary, presdient, presiding officer or other head of its governing body" (e.g.the A.G.)CCPs416.50, a very easy thing to do for anyone in Sacramento. They are not hard to find.
This does not mean that Davis is not a typical lying leftie for, of course, he is.

I haven't read any papers on that subject lately. I can tell you from my own observations that the pelicans have made a strong comeback over the past 20 years. Anacapa Island (actually three closely spaced islands) is not the only pelican breeding location. There are several others on the neighboring islands.

It seems to me that the pelican was doing just fine with the oil and tar seepage, as were all the other animals in the Channel area, for hundreds and thousands of years. In many ways the "natural" ecosystem included oil and tar.

What caused the problems with the pelicans shells or nesting sites, I am not sure. But I watch those pelicans at dusk, dive-bombing the breakers for fish, and all seems right with the world. Now, if we could just get rid of Davis!
