Very interesting, when compared with details provided by the
VD's on Americas Most Wanted website.  www.amw.com

The photos below are of the Van Dam backyard and show the sliding glass door reported to have been found open the morning Danielle was reported missing. Detectives say this is likely to be the way a possible kidnapper may have entered the home.

This is the original post, from the February 9, 2002 broadcast of Americas Most Wanted.  As of March 4, 2002, it was still posted on the AMW website.

Additional Quirks:

Danielle was last seen wearing blue flowered pajamas with flowers
Her favorite colors are pink and purple
Danielle belongs to her local Brownie troop

San Diego police are scouring the Sabre Springs area for 7-year-old Danielle van Dam.  Police say Danielle's parents, Damon and Brenda van Dam, reported her missing when they discovered Danielle was not in her room at about 9 a.m. Saturday, February 2, 2002.

Damon told police he put Danielle and her two brothers to bed at around 10:30 Friday night while Brenda was out celebrating with friends until about 2 a.m. Saturday, a send-off for a woman who was leaving the area, detectives said.  When Brenda arrived home with four friends at about 2 am, police say they ate pizza with Damon and talked for about an hour.  Shortly after the friends left, police say Damon and Brenda told them they noticed lights blinking on their burglar alarm panel and found a sliding glass door and a side garage door open. Police say the alarm was not set, but the panel is a type that indicates when doors and windows are opened and shut at all times. The couple told police they closed the doors and went to bed, and did not check on the children

Saturday morning, police say the couple told them a friend stopped by at about 9 am to see if Danielle could come out and play.  Damon and Brenda told police that they thought Danielle was still sleeping and that Brenda went to wake Danielle.  That is when police say the couple discovered Danielle was missing from her room and called 9-1-1.

Police began investigating immediately, using helicopters, horses and dogs to search the area canyons for Danielle, a second-grader at Creekside Elementary School in Sabre Springs. Officers also conducted door-to-door searches and provided the Border Patrol and Customs Service with photos of Danielle to keep watch for her at the border.  Detectives additionally interviewed family members, neighbors, schoolmates and friends about the disappearance, hoping to develop leads, but had no luck. 

Danielle was last seen wearing blue pajamas with flowers. She is white, 4 feet tall and weighs about 58 pounds. She has blue eyes and blond hair.

Police say at this point the parents are not considered suspects and have been extremely cooperative with investigators.  Police are considering one of the van Dam's neighbors to be the prime suspect.  Police have searched his home and impounded his vehicles.  At the time of this writing, an arrest has not been made.


The most recent Television Interview with the VD's contradicts what they told SDPD and AMW just 2 weeks ago!!  The March 2 interview will be the third major revision to the events of the evening of Feb. 1-2, 2002.

Recap of the Americas Most Wanted MISSING PERSONS REPORT…..

1.                  Kids Put To Bed at 10:30 P.M., by Damon VD.

2.                  Brenda arrives at VD residence at 2:00 A.M. with FOUR FRIENDS

3.                  Brenda and her friends "The Four Amigos" eat pizza with Damon, and “talk” for about one hour.

4.                  3:00 A.M., "The Four Amigos" depart the VD residence.

5.                  Damon and Brenda notice the alarm lights blinking.

6.                  Damon and Brenda notice BOTH the sliding glass door AND the side garage door are open.

7.                  Damon and Brenda note that alarm was not “SET” but was only in the monitoring mode.

8.                  Damon and Brenda tell police they closed all doors, and went to bed.

9.                  Damon and Brenda DID NOT CHECK on the condition of the children.

10.              Approximate time, 3:15 A.M.

I was wondering when you would resort to sophomoric name-calling.

If you had read my post instead of reading into it what you wanted so as to begin your tirade of insults, you would have realized I was wondering HOW he could have done all of this without being seen. I did not, nor have I EVER posted that DW is not the perp. I did not, nor have I EVER posted DW acted in concert with others. I did not, nor have I EVER posted he could not or did not whisk the little girl away unseen, or that he carried her over a fence. You may have read that from other posters, but you DID NOT find it in any of mine. I merely wondered and questioned how he could have done this undetected. Your idea of responding is to resort to typical churlish insults and sarcasm.

I see five houses clearly on that shot, I see no street lights on a sizeable chunk of sidewalk

And DW lives across the street, out of the picture. Not directly across the street fromteh VanDams. If I am not mistaken, the alleged perpetrator lives on the same street, but on the other side of the intersection, which is indicated on the photo displayed above. As I live in a suburb not unlike that of the VD's, I can be fairly sure there is some type of street-light near that intersection. But, we cannot discuss the light, as it is not in the picture.

Why on earth would the defense bring up the "swingers" angle?

This is probably the best strategy Westerfield and his attorneys and come up with. If they can get the idea out there that the Van Dam's were partying with other people that night, then one of these folks could have been the perp. Somebody else or the Van Dams may have then gone on to frame `the wierdo down the street'.

Remember, all Westerfield and co. have to do is establish a reasonable doubt to avoid a conviction. It worked well enough for OJ with that ``Colombian necktie'' bit. If they can do this using the media before the trial, then the DA's office may be willing to accept a manslaughter plea or something.

Maybe they have Sidney Blumenthal's conspiracy flowchart. You know, start with Rick Roberts or Art Bell or whoever, and then begin moving up the media foodchain. Eventually a legitimate source like Drudge gets his mitts on it, and then it's open season.

I don't know if the judge would allow evidence of their lifestyle into the trial. Gossip and hear-say would be laughed out of court...but, if he did, the defense would bring up the issues to create doubt in the jury's mind. BUT...my guess would be that defense will be arguing against the evidence seized and they'll be trashing the vd's in public via the medai. BTW, I wonder why the perps little friends aren't talking about the pedophile paraphernalia recovered from his house.

There are a lot of hiding spots and shadow creating/obstructions for him to hop to and fro..according to those pics.. (tall bushes etc..) Those details don't really mean a lot to me at this point. He was able to remove her and not be seen some how and that's the bottom line. :( BTW, we live in a new neighborhood and there are entire street blocks without a street light. Maybe 1 streetlight every other block)

Oh, yeah, if you find the person who stole your car after you left the keys in the ignition, they WILL arrest him. However, Luis, I must warn you about such careless thinking. Here comes the "refusal to pay" part...

"Loss of or damage to your car arising from theft when ignition keys are left in or on your car".

What you just read is an "exclusion" in most motor insurer's policies. It's in the small print. So you were saying about who's to blame if something valuable is left unlocked?

But wouldn't the/a gag order prevent this?

DW's lawyer argued for a gag order but that was denied for now. Seems to me if he wanted to trash the VD's, then he would not want a gag order. Then, of course, his client is fair game as well if there is no gag order. If both sides agree or argue for a gag order, then perhaps there is truth to the swinging...can't have that get out if you are a lawyer for the VD's.

These represent attempted abductions: for example, luring of a child for the purposes of committing another cnme.

Policy Focal

These are ( 1) the coerced and unauthorized taking of a child into a building, a vehicle, or a distance of more than 20 feet; (2) the detention of a child for a period of more than an hour; or (3) the luring of a child for the purpose of committing another crime.

Findings.
Broad Scope: Children aged 4 to 11 experienced most of the attempts. Most involved attempts to lure children into cars rather than attempts to take or detain.

Political Focal:
Almost half of the victims were children age 12 and older. Seventy-four percent were girls. Sixty-two percent of the perpetrators were strangers and 19% were acquaintances. Most were removed from the street (52%) and taken to a vehicle (46%). Force was used against 87% of the victims; it involved a weapon in 75% of the cases. Ransom was requested in 8% of the cases.

Q: How many missing children are there?

A: According to the National Incidence Studies of Missing, Abducted, Runaway, and Thrownaway Children conducted by the U.S. Department of Justice and released in 1990, the yearly estimates of each type of “missing child” are

Family Abductions - 354,100
Nonfamily Abductions - 3,200 to 4,600
Attempted Nonfamily Abductions - 114,600

Runaways - 450,700
Thrownaways - 127,100
Lost, Injured, or Otherwise Missing - 438,200

Please note researchers caution that these individual categories may not be summed for a total figure for all missing children.

Q: How many missing children are found deceased? What hours are most critical when trying to locate a missing child?
A: According to the State of Washington’s Office of the Attorney General“the murder of a child who is abducted ... is a rare event. There are estimated to be about 100 such incidents in the United States each year, less than one-half of one percent of the murders committed”; however, “74 percent of abducted children who are murdered are dead within three hours of the abduction.”
I picked up a few other bits from the the statistics and reports section of Missing Kids>
It's not a new thing, it has happened many times in many places. I believe it is increasing due to the ease of obtaining very hard core child pornography over the internet, inflaming an idle fancy or curiosity into fixation and obsession.

The pedophilic culture has observed the success of militant Gay Liberation. Even now they are putting forth "studies" showing that "intergenerational sex" is not harmful. They too, agitate for declaring pedophilia a lifestyle, not a mental illness.

Why, if we would just accept and tolerate their "choices" and give them our children as "love partners", they wouldn't have to resort to "crimes of passion".

I had my car stolen wityh the keys in the ignition once. I din't get $$$ from the insurance company, but the punk that did time for the theft paid me.

Yeah, you're right. Most people don't see what's really going on. And I'm sure Walsh wouldn't say anything, lawsuit or no, because he wants Westerfield convicted, like the rest of us. But surely the pro bono PR folks are getting to a point where they'd think they've done enough pro bonoing for the VD's?

Luis, you are a total immature jerk. You fail to see that a person is "culpable" when his car gets stolen under the circumstances you describe? That is WHY the insurance company doesn't pay. Because you were dumb and dumber leaving your keys in the ignition.

The van Dams could possibly be culpable if they contributed to the negligence of their home and the safety of their children that evening. Their lies and cover-ups are pointing to them hiding "something", and it has nothing to do with their reputations, they were well known swingers.

Oh, Luis, there are people who lose custody of their children for doing less.

We seem to have different standards. I take care of my property and family and would never leave the keys in the ignition of my car or front door. Why not just post a sign "STEAL ME".

But back to the parents of the year. They have told so many different versions of what happened that evening that it all goes to their credibility, and you can bet the farm, the defense will bring it up.

What's worse, because of their own lies, they may actually lose the case against Westerfield, if he is the perp. Feldman will work his magic, starting with "the van Dams can't even tell time looking at a clock"...

I don't know about paraphernalia, but I believe they found some child porn in his house or on his computer or both--one story had it that they weren't sure of the age of the "models," but later they added the child porn charges, so they must have decided they were under age.. FresnoDA, wasn't there an article about this somewhere?

I would think that eventually the PR firm will stop representing them--but until they do, remember that these are the "big guys" in PR work--they've represented huge corporations as well as politicos, so they know their stuff.
