Supreme Court rules on Trump tariffs in major test of executive branch powers

The Supreme Court on Friday blocked President Donald Trump’s use of an emergency law to unilaterally impose sweeping tariffs on most U.S. trading partners, delivering a blow to the president in a case centered on one of his signature economic policies — one he characterized as "life or death" for the U.S. economy.

In a 6-3 decision, the justices invalidated Trump's tariffs.

The Supreme Court heard oral arguments in November in the case, which centered on Trump’s use of the International Emergency Economic Powers Act (IEEPA) to enact his "Liberation Day" tariffs on most countries, including a 10% global tariff and a set of higher, so-called "reciprocal" tariffs on certain nations.

POTUS is talking to the press and giving a Master Class on Presidential Governance. Tariffs will go on, 10% across the board. Certainty has returned to the Markets. Ashamed of the Justices who voted for. Asked will he work with Congress to work on Tariffs going forward he says “I don’t have to, already have other tariff options.

Country by country Trump can employ quotas as bargaining in new negotiations to achieve the current already negotiated tariff results, but the administration’s lawyers will have to be careful which statute(s) they chose for doing that.

It may not make sense but this is the Constitutional order. Only Congress can raise taxes, and a tariff is a tax. This is part of the separation of powers.

No, Trump was exercising his authority properly, and the Supreme Court, which was IN ON THE STEAL of 2020, is just doing more blocking of Trump's dismantling of the Deep State.

The bad guys on the SCOTUS are owned lock, stock and barrel (Roberts, maybe some other so-called 'conservatives'like Gorsuch and Coney) OR they are outright doctrinaire Communists like Kagan, Jackson, and the Wise Latina.

Trump will do his best to make the US free again, and the Communists and compromised will fight him every step of the way.

I am just unhappy with the POTUS for having selected traitors and ingrates to the SCOTUS. Unforced error on his part, and a big, big one.

VERY stupid for Trump to have put these people in the Court, for decades and decades to come. Very stupid.

They didn’t demand that the tariffs be given back or how.

Why?

I would argue that they knew what was coming.
The Supreme Court did not throw out the tariffs that Trump placed on countries because of “national security.”

Why?

The Constitution gives the president “plenary power” over “national security.”

The Supreme Court knew that was coming.

They literally DISTINGUISHED what tariffs are legal and what tariffs aren’t.

That’s a great PRECEDENT for the future.
Clear law instead of purposely ambiguous law, that allows for future abuse.

Trump just exposed the corrupt IEEPA law in order to set the table to get rid of it.

And trust me.

Fantasy world. Tariff leverage is gone. All alternatives will be challenged and given the compromised judicial branch, likely, overturned again. No country will take the tariff threat seriously again.

You are blind to what just happened. The Supreme Court struck down specific tariffs that were based on the IEEPA law and left in place ALL the tariffs that Trump placed on countries because of “national security.” So what does Trump do? He immediately goes out and restores the same tariffs by declaring “national security.” Nothing has changed. The tariffs still apply and now there is legal clarification. The president has “plenary power” under the Constitution, when it comes to “national security.” Checkmate! It was the perfect boomerang!”

When people go ad homenim attacks I know I’ve already won the argument. I hate chicoms as much as anyone here, but they are already killing their own economy through government intervention. And supply chains have already shifted to other Asian countries as US companies don’t want to be tied to China after what happened in Russia.

If Trump wants to use the 1974 Trade Act by all means have at it. We will see how that goes. But the emergency powers act is off limits and we should all be thankful because the next democrat to hold that office would abuse the hell out of it.
