Why blue states' new anti-ICE laws are unconstitutional virtue signaling

Illinois has now joined California and Connecticut in barring federal immigration agents from conducting "civil arrests" of illegal aliens in or around state courthouses. The sanctuary law appears largely performative since it also appears unconstitutional. It is difficult to see how a state can bar the exercise of federal jurisdiction, at least after the Civil War.

Gov. JB Pritzker has been ratcheting up the rhetoric against ICE and the Trump administration for months, including analogies to the Nazis and claims that democracy is dying. The new law, however, crosses the constitutional Rubicon by not only limiting the operation of Immigration and Customs Enforcement (ICE) but also establishing a 1,000-foot "buffer zone" outside of buildings.

The law makes courthouses equivalent to churches, where suspects can claim sanctuary not only when they cross the threshold but also within 1,000 feet, unless, of course, ICE ignores the law.

Recently, the chief judge in Cook County issued an order with the same prohibition. A few other judges in other states have issued similar orders.

ILLINOIS LAWMAKERS PASS BILL BANNING ICE IMMIGRATION ARRESTS NEAR COURTHOUSES

The authority for the orders is highly dubious.

The federal government can cite laws mandating the arrest of certain individuals for immigration violations, including mandatory detention of certain aliens who are removable due to criminal convictions or terrorist activities and detention and removal of aliens with final orders of removal.

The most immediate problem for Illinois is the supremacy clause of the U,S. Constitution, which states: "This Constitution, and the Laws of the United States which shall be made in Pursuance thereof[]... shall be the supreme Law of the Land[]… any Thing in the Constitution or Laws of any State to the Contrary notwithstanding."

As long as there’s massive election fraud, the democRATS will have a chance. THAT needs to be fixed, and it should have been fixed in Trumps first term but the RINOs just didn’t want to do it. Probably because some of them (McConnell???) benefit from election fraud themselves.

“ratcheting up the rhetoric against ICE”

The liberals noticed that their nazi rhetoric resulted in several assassination attempts on Trump, so now they are using it to get ICE agents shot.

Actually no. Mitch “bitch” always was reelected easily. Mitch just wanted to maintain the status quo of a “Royal Congress of elites.” He was a master of legislative protocol and process. He is a good man and a bad man at the same time.

I have always wondered about his wife. She married Mitch whom was ten years her senior. She was a Chinese National that had American citizenship. She was also rich prior to marriage with business connections to the CCP. She was not beautiful but without doubt extremely attractive. Perhaps she was the real deal or perhaps not. I lean in the direction of the real deal.

Now that Arizona bass turd, Markus Kelly, is going to start the crap with the military advising soldiers to disobey all their orders. Kelly needs a big boot in the ass. I’d also advise the boy to start buying his suits from Trojan. He look more and more like Gollum every day which makes it easy for him to pass for being Jimmy Carville’s retarded little brother. I will be dropping some letters advising people in the government that Kelly the Ass have everything regarding the military taken away from his goatsmellin’ commie ass and that the bass turd not be allowed to come within 500 yards of military personnel.

unconstitutional

Not the point. The point is to tie ICE up in court over and over again while they run out the clock.

State Court buildings and courtrooms could simply demand presentation of a federal search warrant before providing entry.
