Politics Appeals court won't rehear Trump's appeal of E. Jean Carroll defamation, sexual abuse case By Updated on: June 13, 2025 / 11:38 AM EDT / CBS News

President Trump on Friday lost his latest effort to get a retrial in the case in which a jury found him liable for sexual abuse and defamation of the writer E. Jean Carroll.

After the U.S. Court of Appeals for the Second Circuit denied Mr. Trump's appeal of the case in December, his lawyers — now top officials at the Department of Justice — asked for an en banc review, in which all the judges on the court consider the case.

That request was denied Friday. Mr. Trump has previously indicated he would challenge the case all the way to the Supreme Court. The nation's highest court is now his last hope of overturning a unanimous jury's conclusion that Mr. Trump was liable for $5 million in damages to the writer.

On to SCOTUS it goes.

SCOTUS has to want to hear the case. It's not an appeal as of right. Robert, Barrett, and Kavanaugh are all suspect.

In Florida, in Judge Aileen Cannon’s jurisdiction.

Only thing is, they know the conservative judges would never do the crap that is common amongst DC and NY judges.

But then, they also know that conservative judges abide by SCOTUS rulings. So if they ruled that there doesn’t have to be any evidence for 30-year-old allegations, that’s what Aileen Cannon would go by...

But then, 30 years is beyond the statute of limitations. The FL legislature would have to pass a law allowing a year-long window where the statute of limitations doesn’t count.

Like NY did to make the suit against Trump possible.

The lower court judges are just running with the ball.

Time for them to rein in all the judicial terrorists, and for the Congress to put constraints on all of them.

Carroll's story was highly improbable, she offered no evidence, she never filed a police report, the alleged event happened at least 25 years ago, and the dress she said she had been wearing wasn't even on the market at the time.

How likely is it that Trump would sexually assault a woman in a Manhattan department store during business hours, when any commotion would likely be heard by employees or other customers? And since when is defending yourself - "I didn't do it, she's lying!" - "defamation"?

Kavanaugh was accused of sexual assault. He should be sympathetic to Trump's case. Hopefully, Trump gets the fourth justice needed to hear the case.

I doubt SOTUS takes this case. They only have two weeks left and I’m sure have too many cases already. Maybe they could wait until October.
