I have always thought congress should spend every other year repealing old laws no longer needed.
Interesting headline. Trump has made it harder to be imprisoned for violating Federal regulations as opposed to Federal laws. I believe this is much more in keeping with the Founders’ vision of how the Republic should function.
Yes. The USSC has whittled away at some of the abuses of regulators. But much more needs to be done to prevent regulators from creating laws under the guise of regulation. Stuff like taking away a private 2 acre lake sitting in the middle of a 250 acre property... it’s not a waterway or watershed it’s a private, self contained pond. EPA stay away. Many more such things. Taxes are even worse for many people... audits can take forever and require too much work for individuals who are sincere but not necessarily expert - even the damn software you can buy is confusing. Though about 20% of the auditors left the IRS this year. A good start.

I’m still wrapping my mind around this, trying to figure out Trump’s basic intention. It’s not a topic I have given much thought to before. I guess time will tell.

The idea is that by enforcing a bad law rigorously, its negative consequences will become so apparent that public pressure for its repeal will grow, ultimately leading to its removal.
Orwell gave the subject of byzantine laws some treatment in 1984.
Political enemies giving you some trouble? Find an arcane law or regulation on the subject of, say, document de-classification or mortgage loans.
*Caveat re arcane political law enforcement: Make sure your friends haven’t broken them as well.
Wow. That quote is absolutely perfect for the city ordinances in my town. The city can force anybody to do anything with their property as long as the police chief wants it. If the police chief doesn’t like anything about your property, he can declare it a nuisance and if you don’t “fix” it, then the city will bulldoze their way in, “fix” it, and charge you for that “service”. it’s all right there in black and white in the city ordinances. It lists some things that might be considered nuisances but specifically states that the list is not conclusive and it’s entirely up to the police chief.
If he doesn’t like the color of your house, he simply calls it “unsightly” and orders you to paint it his preferred color or else paints it himself and charges you for it. If you want to post a sign on your lawn you have to have permission first, and if the police chief doesn’t like what it says he can say it reduces the value of the properties closeby and force you to take it down.
The property owner can request an appeal hearing, but they would have to prove that the police chief really didn’t think something was “unsightly”, that their vegetation was “unuseful”, or that their property made life uncomfortable for any karen in the town looking for something to b!tch about. Because there is no objective standard, only the opinion of the police chief that matters, and that opinion justifies the city making changes to property against the will of the property owner and then charging the property owner for those changes.
The spirit of those ordinances is EXACTLY described in that “Atlas Shrugged” quote. I’ve not read it, and I very much appreciate you sharing that.
I read recently of an EO in the works that mandated writing in a mens rea requirement for the execution of all these many laws and regulations. I’m thinking it means if the law is applied with bad or evil intent, then those who apply it are liable under law. I’m not a lawyer. I don’t play one on TV. I’m often an idiot!
The common law required both mens rea (’evil mind’) and actus reus, an act— a joint combination.
This strict liability regulatory stuff is real Wesley Mouch stuff.
The problem is unelected public administrators gone wild. Something like federal judges.
It’s mathematical. The best way for a government to be able to control its people is to create greater ability to incarcerate them. As the number of statutes and regulations increases, so does the probability that the average citizen can be arrested.
Trump is simply replacing communism with MAGA.
That’s exactly why I sold my house in a small resort town and now live 15 miles from the nearest small town, ten miles from the nearest settlement, and 140 miles to the nearest city.
