Overview: Gwynne Wilcox (a member of the National Labor Relations Board) sued President Donald Trump challenging her removal from the National Labor Relations Board as a violation of the National Labor Relations Act, claiming that Trump did not meet the standard required for Wilcox’s removal under federal law and that Wilcox was not given notice and a hearing to contest her removal. Judge Beryl Howell ruled in favor of Wilcox, holding she was unlawfully removed from office. The Trump administration appealed and the case is now being heard in the U.S. Court of Appeals for the D.C. Circuit.

Order: UPON CONSIDERATION of the application of counsel for the applicants, IT IS ORDERED that the March 4, 2025 order of the United States District Court for the District of Columbia, case No. 25-cv-412, and the March 6, 2025 order of the United States District Court for the District of Columbia, case No. 25-cv-334, are hereby stayed pending further order of the undersigned or of the Court. It is further ordered that a response to the application be filed on or before Tuesday, April 15th, 2025, by 5 p.m. (EDT).

Justice Roberts has stayed the Order from Judge Beryl Howell that found the head of the National Relations Labor Board was unlawfully removed.

You can read the Order at the link.

For now, we will count this as another win for the Trump administration.

I’ve said it for years: Trump’s MO is to lose in the lower, activist courts and win in the upper, more thoughtful adult courts. It’s become a lot of fun to watch these cases play out since he was elected.

Very few people are aware of that Consent Order that was renewed every few years to make sure it stayed in place. The GOP entered into an agreement to never contest a federal election.

Such an agreement was a betrayal of conservative voters and allowed the Democrats to cheat at will.

The retired judge came out of retirement occasionally just to sign the renewal of the order. It was only a few years ago that the Consent Order was not renewed and was finally allowed to expire.

Stupid she is not. And please quit insulting our pets. The leftist are not stupid just because they will do seemingly stupid things to advance their cause. In fact most leftist are very smart in the arena of politics. She knows full well her ruling would never stand but she doesn’t mind because it drags the whole process leftward. Her otherwise idiotic unconstitutional ruling anchored the left wing and biased Roberts ruling toward the left.

Trump understands anchoring. It’s why he says and does and outrageous things. He more than drags things to the right so that even this judge couldn’t entirely offset his gambit.
