San Diego sheriff defies new policy to limit cooperation with immigration officials

SAN DIEGO (AP) — The sheriff of the nation’s fifth-largest county on Tuesday defied a new policy to limit cooperation with federal immigration authorities, setting up a showdown...

Earlier Tuesday, San Diego County supervisors voted to prohibit its sheriff’s department from working with U.S. Immigration and Customs Enforcement on the federal agency’s enforcement of civil immigration laws...

Shortly after, Sheriff Kelly Martinez said the board does not set set policy for the sheriff, who, like the supervisors, is an elected official. She said she wouldn’t honor the new policy....

If we had a media that was actually made up of patriotic citizens, they would ask all these leftist politicians why it is they chose immigrants over citizens. I mean, we know the answer for most these sorts of locales but it would be nice to hear the question asked and answered at some point. Why is it citizens last?

Statement on Board of Supervisors Vote on Immigration Enforcement

Today, Sheriff Kelly A. Martinez issued the following statement related to Chairwoman Vargas' board letter on adopting a board policy on immigration enforcement. The Sheriff respects Chairwoman Vargas and the members of the Board of Supervisors; however, she has been clear on her position on this matter.

As stated in the Sheriff's statement, she will continue to follow state law and there is no loophole in state statute as referenced in the Chairwoman's board letter. Current state law strikes the right balance between limiting local law enforcement's cooperation with immigration authorities, ensuring public safety, and building community trust.

State law allows for the Sheriff's Office to share release dates for individuals who are in Sheriff's custody only if they have qualifying convictions for specific serious, violent, or sex crimes. Government Code 7282.5 gives the authority for law enforcement to cooperate with immigration authorities, as prescribed. This includes the ability to provide information on individuals who have certain convictions which include but are not limited to sexual abuse, child abuse, battery, assault, possession, sale, distribution, manufacture or trafficking of controlled substances.

The San Diego County Board of Supervisors are aware of the Sheriff's position on this topic, as she has presented to them and the public during the annual Truth Act Forum on her policies and practices when it comes to following state law as it relates to immigration enforcement.

The Sheriff's Office will not change its practices based on the Board resolution and policy that was passed at today's meeting.

The Board of Supervisors does not set policy for the Sheriff's Office. The Sheriff, as an independently elected official, sets the policy for the Sheriff's Office. California law prohibits the Board of Supervisors from interfering with the independent, constitutionally and statutorily designated investigative functions of the Sheriff, and is clear that the Sheriff has the sole and exclusive authority to operate the county jails."

They don’t operate off the same premise as us in the question you propose they ask. In their mind the illegals are citizens, so the question wouldn’t even make sense to them

I’m sure a lot of Sheriffs are already thinking what she is saying out loud. They know more about dealing with gangs of illegals than these boards do.

Pr0lem is, these filthy county boards control funding. On the other hand, it would be a shame if communist members started getting a rash of traffic tickets, petty crime arrests, kids’ in trouble etc.😎

The sheriff here was called up during desert storm.

The county board decide he shouldn’t be paid while on active duty.

The courts ruled that he should be paid.

Basically if your an elected official.

The voters decide.

As long as we have any welfare state programs they must be held accountable that America has less than 4% of the world population and big welfare programs that it cannot afford for over 96% of the world and that we have to have a workable system for immigration or else it means the sure collapse of their welfare state.

And the sheriffs need to add “you cannot nullify federal law nor order me to do that. The Supremacy Clause is still in effect.”

Sorry for stating the obvious I guess...but i have a brother in law who is a rabid leftist...and I am very well tuned into their logic...which is why I said what I said.

I’ve come to learn that conversation and debate is impossible, because we will never be on the same premise...even if the one i am on is the 100% legal and logical one.

Frustrating.

I have an extreme lefty cousin who operates off of headlines only. If he likes the headline, it’s 100% true. If not, it’s fake news, Republif*ck made up lies.

He portrays himself to be a nice person, in person. Online, it’s a different story where abuse & filthy comments are his stock in trade.

Some weeks ago, I forget to remove my Trump cap when visiting him & his common law wife (she owns the house and lot and has a job.) He remembered and a couple of weeks before the election I texted him to see how he was doing; he’d been ill. After a couple of exchanges, he abruptly turned to politics. Trump this, chump that and some profanities. I ignored, there is no chance for discussion.

That day and over the next two, he did not let up. Every 2 or 3 hours, several more rabid text messages, with me not answering at all. I eventually blocked text messages but, as he had a birthday on Nov. 13, I unblocked to send him a birthday text, to go along with the birthday card & $25 Subway gift card I enclosed with it.

His answer was to send back to me the gift card, preceeded with a text saying he hates me and everyone like me and a second text telling me if I ever visit, “I will beat your f*cking ass MF.”

I had thought after the election, however it went, he would calm down. Wrong. His brothers want nothing to do with him and that’s how it stands with me, now. He has chosen politics over family.
