Senator Alex Padilla (D-CA) said Sunday on CBS’s “Face The Nation” that “there’s no obligation” for California state and local officials to assist with President-elect Donald Trump’s deportation plan.
Partial transcript as follows:
MAJOR GARRETT: You know, President elect Trump has promised mass deportations. You also know, in California, there is a state law that tells local law enforcement not to participate and cooperate with ICE agents in deportation or identification processes. The incoming Trump administration border czar, Tom Homan, has said any law enforcement who don’t cooperate will be prosecuted under federal law. How is this going to be resolved?

That's not even close to what he said. He said that anyone who hinders, impedes or obstructs federal immigration officers in the performance of their duties is subject to prosecution consistent with 8 USC 1324.
He did not say he would prosecute someone for lack of cooperation. The state and local LEOs are under no legal obligation to offer assistance to ICE but those who care about public safety will jump at the opportunity.
California thinks it is an far-flung autonomous colonial outpost out of reach of the King or Emperor oceans away.

fine. 47 is under no obligation to not have you arrested and prosecuted either.
actually the wording here is technically correct, they are under no obligation to assist, BUT they can not obstruct or harbor illegal aliens without risk of being prosecuted themselves.
Can LE assist when they’re off-duty? A lot of cops would be very happy to help getting rid of the illegals.
They can’t legally refuse fed administrative subpoenas for information.
