Former President Donald Trump said Thursday that, if elected to a second term in November, he would immediately fire special counsel Jack Smith, who brought two federal indictments against Trump.
Conservative radio host Hugh Hewitt asked Trump if he plans to pardon himself or fire Smith on the day he would take the oath of office.
"It's so easy — I would fire him within two seconds," said Trump, who added that he got “immunity at the Supreme Court" and called Smith a "crooked person."
The former president also said he doesn't think Democrats, if they retake the House majority, would impeach him if he fires Smith from the Department of Justice.
Smith's office declined to comment on Trump's remarks. Firing him as special counsel potentially could end the federal government's prosecution against Trump. While Smith has appealed the ruling in Florida dismissing the classified documents case against the former president, the special counsel is still pursuing the election interference case against him in Washington, D.C.
Trump has successfully delayed court proceedings in the election interference case because of his claims of presidential immunity, which were ultimately ruled on by the Supreme Court in July, so a trial has not been set in the case.

I think Trump has to first nominate an Attorney General to replace Merrick Garland. Then the Attorney General must be confirmed by the U.S. Senate. After confirmation, the new Attorney General fires Jack Smith, if he hasn’t resign by now. I wonder (1) will the Democrats fight hard against any Attorney General nominee and (2) will Jack Smith refuse to resign and wait for the new Attorney General to fire him?

I’m tired of the MSM dictating who gets to keep their appointments when republicans are in office.
It will be like Cosmo Kramer on Seinfeld, I don’t really work here.
MY transition staff would include the head of the US Marshals Service. Purpose would be to coordinate having a pair of marshals at every office location where a current political appointee works and physically bum rush them out the doors @ 12:01PM. Secretaries, heads of departments and their deputies.
Here are some facts from my point of view:
1. Jack Smith was unconstitutionally appointed to his position by Merrick Garland (otherwise and more properly known as “Meritless Garbage”). As such, within literally a few seconds after Trump has finished taking the oath of office next January 20, US marshals should enter his office, escort him out of the office and remove his security clearance, if any, and unceremoniously dump all of his possessions on the sidewalk outside of the building. At 9 o’clock on the next business day, he should be brought up on charges of unethical behavior in front of every single bar association of which he is a member. This guy needs to never be able to practice law again. He knew and knows that he was not properly appointed. On top of that, he has, violated department of justice guidelines about bringing a prosecution against a presidential candidate so close to an election, and that constitutes a further ethical violation. I am sure that somebody can find some crimes that this POS has committed, and he should be charged with them, as well.
2. The Supreme Court did not grant Trump immunity. What they did was not just for Trump himself, but for every future president. They didn’t give total immunity which was, practically speaking, the fact since 1789, as no other president has ever been prosecuted for any crime while in office or afterwards. What they did do was to give absolute immunity to any president for performing duties that are clearly required under the constitution. With regard to other actions, there is a presumption of immunity for actions that are carried out under the authority of the President of the United States, though this presumption can be overcome. Finally, the Supreme Court made it clear that no president enjoyed immunity at all for purely personal actions - so, for example, if a president takes a gun out of the Resolute Desk and shoots somebody in the Oval Office for no reason that appears related to his duties as president, he will be fully liable for all criminal and civil penalties. What Trump is being accused of by Jack Smith would fall into the middle category of “presumptive immunity”,” which is fairly difficult to overcome.
What everybody should take away from this Supreme Court decision is that no further rights or powers were granted to any presidents, including Trump, due to this decision. In actuality, presidential immunity was cut back considerably, though the media doesn’t want to present it that way because Trump benefited from the decision. However, Justice Gorsuch specifically mentioned in the oral arguments that whatever decision the Supreme Court was rendering would echo through the ages, that it wasn’t just about this particular president, it was about all future president. I am thus confident that the decision was about as good as it could have possibly been without direct language in the constitution, or direct evidence of the intent of those who wrote the constitution.
He should fire the entire DOJ on Day 1.
I like the fact that he is saying this before the election. It will cost Trump zero votes, and will be the mandate of the people when he fires the rat.
In thinking about it, I’m not even sure “firing” is the right concept. Since Smith was illegally appointed in the first place, it ought to be a matter of declaring whatever gimmick Merrick Garland used to pay him null and void.
Fire all the department heads down to 5th level of management including staff. The budget needs to be cut 50%.

Clinton fired nearly every single federal attorney when he became president. Reno got rid of 93 out of 94. Sounds like a good idea.
I would really enjoy watching and listening to that.
