MEMORANDUM AND ORDER
This matter is before the court on Defendant’s motion to dismiss based on Second Amendment grounds. (Doc. 26.) A response and a reply have been filed (Docs. 28, 29), and the court held a hearing to establish additional facts about the weapons charged. The motion is thus ripe for review. The court finds that the Second Amendment applies to the weapons charged because they are “bearable arms” within the original meaning of the amendment. The court further finds that the government has failed to establish that this nation’s history of gun regulation justifies the application of 18 U.S.C. § 922(o) to Defendant. The court therefore grants the motion to dismiss.

A full auto BCG is no more or less legal than ANY other FA part of the fire control group. What makes you a criminal is drilling the auto sear hole in the receiver. Most AR-15 receivers won't even accept the auto sear if you drilled the hole. A M-16 receivers fire control well is NOT tapered at the safety / auto sear section of the receiver like most common AR-15 receivers are. So to install an auto sear not only do you have to drill for the auto sear pin but you also have to mill the receiver. A receiver that has a full auto fire control well is not even illegal. They are available for sale by many manufactures if you know what you're buying and are NOT an NFA item. As long as it doesn't have the hole for the auto sear pin it's legal to own. Now if you owned a receiver with a full fire control well AND an auto sear they would probably try to pin constructive intent on you. In other words if you had all the correct parts laying around thinking that if TSHTF someday you would build yourself an M-16 ............. well guess what that is constructive intent. On the other hand if you owned a common AR-15 with tapered fire control well and a bunch of FA fire control groups; your just a collector. They MAY try to rattle your cage wondering why you have them but you are NOT a criminal. Taking it a little further; if you owned said AR-15 and a FA fire control group that you had displayed in, let's say a shadow box on your desk as art. The agent would probably say "oh that's cool" and move on. Reality is the likelihood of being face to face with an ATF agent isn't very high unless they already know what they are looking for. ATF agents aren't showing up to your house because you bought a M-16 parts kit. Those things are and have been sold by the 1000's; just imagine how many ATF agents would need to be hired to follow up on all of them.
Knock yourself out with that one.

I’m not a fan of bump stocks, but am fine with weapons designed for full auto firing...if “they” can have them, we should be able to have them - same with suppressors...
Next step, to get crew served weapons covered by the second amendment, using the militia clause.
That would restore our country to its original state, when privateers were given letters of marque and reprisal.
Private ships were armed with crew served weapons and were well regulated (ready to perform their duty).
