It is completely possible that Fitton has a law enforcement source that has informed him about pending indictments against Joe, or more likely, against someone in Joe's family.

According to Article II, Sec. 2, the President may grant "reprieves and pardons for offences against the United States, except in cases of impeachment."

There is no exception for treason. The question which has not yet been resolved is whether a President can pardon himself.

If Biden resigns, he will be safe as long as the DOJ is in Democrat hands, and even if Trump wins, a trial would be held in DC, so the jurors would all be Democrats.

Harris can recommend one, but both house and Senate need to approve, we have a rich history of leaving the position vacant, making speaker number two in line. My guess is that will be the result if Biden resigns.
